Dear President Yudhoyono,
We were deeply concerned to learn of the arrest of Mr Buchtar Tabuni on the 3rd of December 2008 in Sentani, Jayapura. We understand that Mr Sebby Sambom was also arrested while giving a press conference during which he called for the release of Mr Buchtar Tabuni.
We understand that Mr Tabuni was arrested by personnel from the C.I.D. of the Papuan police, that no arrest warrant was presented at the time of the arrest, and that Mr. Tabuni is still being held in detention.
We are particularly concerned to hear that Mr Tabuni may face very serious charges including charges of subversion under articles 106, 110, 160, 212 and 216 of the Indonesian Penal Code.
Mr. Tabuni is an active human rights activist, and a student Association leader. He has
organised a number of peaceful demonstrations, the most recent one being in support of the International Parliamentarians for West Papua which held a meeting in London
on October 16, 2008.
We understand that Mr Tabuni and Mr Sambom have been jailed solely for peacefully expressing their right to an opinion. We believe this right is accorded to your citizens under Law 9/1998. This right is also guaranteed by the International Covenant on Civil and Political rights and by the Universal Declaration of Human Rights.
We are also concerned that they may be ill-treated whilst in custody. We therefore urge you to to immediately release Buchtar Tabuni and Sebby Sambom from custody and we ask that all charges against Buchtar Tabuni and Sebby Sambom should be dropped.
