Imparsial ‘Mengutuk’ Pembakaran Polsek Pirime

Jayapura (27/11) — The Indonesian Human Rights Monitor (Imparsial) ‘mengutuk’ aksi kekerasan dan pembakaran Polsek Pirime, Kabupaten Lanny Jaya, Papua oleh Orang Tak Dikenal (OTK) yang mengakibatkan tiga anggota polisi tewas, Selasa (27/11) sekitar pukul 06.00 pagi.

Direktur eksekutif Imparsial, Poengky Indarti menegaskan, pihaknya mengutuk terjadinya kekerasan dengan cara pembunuhan dan pembakaran terhadap Kapolsek Pirime, AKP Rolfi Takubesi dan  dua anggotanya Brigadir Jefri Rumkorem  serta Brigadir Daniel Makuker.

“Kekerasan yang dilakukan pelaku sangat bertentangan dengan semangat bersama untuk menjadikan Papua sebagai tanah damai. Kami berharap aparat bisa segera menangkap para pelaku dan membawanya keproses hukum,” kata Poengky Indarti kepada tabloidjubi.com via pesan singkatnya, Selasa (27/11).

Menurutnya, dengan adanya peristiwa ini, menjadi sangat krusial bagi Presiden SBY untuk segera mempersiapkan dialog damai dengan pihak-pihak yang berseberangan agar kekerasan di Papua bisa segera di akhiri. Imparsial juga berharap, aparat tidak melakukan tindakan balasan dengan kekerasan dalam mengusut kasus ini karena akan menimbulkan trauma bagi masyarakat.

“Imparsial juga kembali mendesak Kapolda Papua untuk mengintensifkan operasi penyelundupan senjata. Seret dan tampilkan pelaku penyelundupan senjata. Jika penyelundupan tersebut melibatkan aparat militer atau aparat pemerintah yang lain, maka harus ditindak tegas. 

Kasus kekerasan terhadap aparat kepolisian di Papua yang terjadi pada bulan November ini menimbulkan ketakutan masyarakat yang memang sudah lelah dan trauma dengan kekerasan di Papua,” tandas Poengky Indarti. (Jubi/Arjuna)

Joint Oral Statement by the ICJ and FIDH in the Adoption of the Outcome Document in the Universal Periodic Review of Indonesia

Madam President,

The International Commission of Jurists (ICJ) and the International Federation for Human Rights (FIDH) welcome the acceptance by the Government of Indonesia of the recommendation to ratify the Convention Against Enforced Disappearances and its commitment to combat impunity in the country. This commitment is significant not only nationally, but also regionally, since Indonesia plays an integral role in the establishment of an ASEAN human rights mechanism. Combating impunity, which includes fulfilling the rights to truth and to reparation for victims of enforced
disappearances, will not only have enormous positive impact on Indonesia, but also on the entire region.

It is in this light that we support the call of human rights defenders in Indonesia to the Government to set up an ad hoc Human Rights Court to look into the case of 13 pro-democracy activists who “disappeared” from 1997 to 1998. More than a decade has passed since their enforced disappearance and their families continue to wait to know the truth about the fate of their loved ones. 

The rights to truth and reparation are expressly recognized under international law, including under the Set of Principles for the Protection and Promotion of Human Rights Through Action to Combat Impunity, which provides that States should “ensure the inalienable right to know the truth about violations”. In the case of death or enforced disappearance, this includes the right of victims’ families to know the truth about the fate of their loved ones. The Set of Principles also asserts that violations of human rights give rise to the right to reparation on the part of the victim or the victim’s beneficiaries.

We therefore urge the Government of Indonesia to act on its expressed commitment to combat impunity in the country and immediately and effectively resolve all cases of enforced disappearance in the country.

Lawyer complains of lack of professionalism as Buchtar trial

Jayapura, Voice Baptis-- The tight security by the police round the courthouse while the trial of Buchtar Tabuni was in progress was described as being unprofessional by a member of the legal team of the defendant.

Gustaf Kawer said: 'The tight security round the courthouse is a violation of the basic principles of court practice. This is a public trial which means that anyone can come and attend it. Excessive security while the trial is in progress is very unprofessional,' said Kawer.

Buchtar Tabuni is charged with having caused damage to the Abepura Prison on 3 December. The trial hearing was suspended and the trial will resume on 13 September, because witnesses did not turn up for the hearing as a result of which the lawyers promised that they would produce the witnesses, said Matius Murib. The hearing on 13 September will be the last occasion for the witnesses to appear. 

The deputy director of the prison is adequate and will not be summoned again after having be summoned to appear three times. Kawer said that the proceedings were not conducted professionally; the witnesses should have appeared at the appointed time but that did not happen. Furthermore, he said, the judge should behave independently in the way he chairs the court and should not take sides either with the state or the victim.

At today's hearing of the Buchtar Tabuni trial, there were forty people from Dalmas and the the Jayapura police command, who were fully backed up by personnel from the Abepura police command, who were headed by the head of the Jayapura police command, Kiki Kurnia.
