OPINI: KEGAGALAN PEPERA 1969 DAN OTONOMI KHUSUS 2001 DI TANAH PAPUA BARAT

Saya tertarik membahas dalam opini dengan memilih topik ini. Karena, saya terinspirasi dari pernyataan Pengamat Politik dari Universitas Indonesia (UI), Andrianof Chaniago yang mengkritik para kandidat Presiden RI. Dia menyatakan: “ Klaim-klaim soal kebehasilan misalnya soal Aceh, boleh-boleh saja. Tapi yang penting ke depan, bagaimana bisa menyelesaikan konflik-konflik yang sudah menunggu dan akan datang misalnya soal Papua. Kenapa tidak ada yang berani mengklaim soal Papua” (Papua Pos, Sabtu, 20 Juni 2009).
Pernyataan seorang pengamat politik dan sekaligus akademisi ini, tentu saja membuat penguasa Pemerintah Indonesia, aparat TNI/POLRI yang menduduki Tanah Papua Barat dan menjajah orang Asli Papua Barat ini akan membuka mata dan harus berpikir ulang tentang klaim tentang Papua Barat selama ini sejak 1 Mei 1963 sampai sekarang. Klaim-klaim dengan penuh tirani kekerasan, manipulasi, pembohongan di Tanah Papua Barat ini semakin terbuka dan tidak menjadi rahasia umum. Para cendikiawan dan akademisi dalam independesi keilmuan mereka menyampaikan argumentasi secara lugas, logis dan rasional dengan pembuktian-pembuktian ilmiahnya yang sulit dibungkam dan dibelenggu dengan moncong senjata, pembohongan dan manipulatif.
Chaniago menyatakan, “…bagaimana bisa menyelesaikan konflik-konflik yang sudah menunggu dan akan datang misalnya soal Papua. Kenapa tidak ada yang berani mengklaim soal Papua.” Pernyataan ini membuktikan bahwa persoalan status politik Papua Barat dalam Indonesia belum final atau belum diselesaikan. Walaupun, Pemerintah Indonesia, aparat keamanan TNI dan POLRI selalu mengklaim bahwa masalah status politik Papua Barat sudah final.

Belum tuntasnya persoalan status politik Papua tidak saja dibicarakan oleh Chaniago, tetapi seorang cendikiawan Kristen Katolik kenamaan seperti Dr. George Junus Aditjondro juga melontarkan pernyataan yang hampir sama, yaitu: ” dari kaca mata yang lebih netral, hal-hal apa saja yang dapat membuat klaim Indonesia atas daerah Papua Barat ini pantas dipertanyakan kembali.” Bukan Chaniago dan George saja, tetapi seorang cendikiawan kawakan dan terkenal Dr. Ikrar Nusa Bhakti juga menyatakan, “ sejak dulu hingga kini, persoalan Irian Jaya (baca: Papua Barat) bukan hanya persoalan antara Indonesia dan penduduk Papua Barat, melainkan juga persoalan yang menyangkut internasional. Ini bukan hanya mengaitkan hubungan antar masyarakat, antar masyarakat dan pemerintah, antar pemerintah dan pemerintah, tetapi juga antar gereja…”

Komentar-komentar yang merapuhkan eksistensi Pemerintah Indonesia di Papua bukan saja datang dari orang-orang Indonesia sendiri, tetapi akademisi asing juga memberikan kritik yang tidak kalah nilai pengaruhnya. Dr. Robin Osborn dalam bukunya “Perang Rahasia di Papua Barat” menyatakan: “bahwa penggabungan bekas jajahan Belanda itu ke dalam wilayah Indonesia didasarkan pada premis yang keliru. Yaitu ketika 1.025 orang delegasi yang dipilih pemerintah Indonesia memberikan suara mereka dibawah pengawasan PBB diartikan sebagai aspirasi politik dari seluruh masyarakat Papua Barat. Kini, premis ini diragukan keabsahannya berdasarkan hukum internasional.”

Sementara sejarawan Belanda, Prof. Dr. J.P. Drooglver yang menyelidiki hasil PEPERA 1969 yang telah diumumkan pada tanggal 15 Novemver 2005 menyatakan: “Penentuan Pendapat Rakyat Papua Barat pada tahun 1969 adalah sebuah kasus yang dimanipulasi. Akhirnya, perlu dipertimbangkan kembali bahwa kepentingan Indonesia dan Papua pada umumnya sama, karena mereka adalah tetangga dan saling membagi sejarah. Jalan keluar harus ditemukan…” Sedangkan seorang cendikiawan, ilmuwan dan teolog Papua ternama Pdt. Dr. Phil Erari dengan tegas mengatakan: ”secara hukum, integrasi Papua dalam NKRI bermasalah.”

Dr. Ferdinando Ortiz Sanz, perwakilan Perserikatan Bangsa-Bangsa (PBB) yang mengawasi pelaksanaan PEPERA 1969 di Papua Barat menyatakan penyesalannya sebagai berikut. ” saya dengan menyesal harus menyatakan pengamatan-pengamatan saya tentang pelaksanaan Pasal XXII ( Pasal 22) Perjanjian New York, 15 Agustus 1962, yang berhubungan dengan hak-hak termasuk hak-hak kebebasan berbicara, kebebasan berkumpul, penduduk asli. ...syarat-syarat yang penting ini tidak sepenuhnya dilaksanakan dan pelaksanaan administrasi dalam setiap kesempatan dengan pengawasan politik yang sangat ketat terhadap penduduk asli.” Sedangkan Duta Besar Pemerintah Ghana untuk PBB, Mr. Akwei menyatakan protesnya: ” PEPERA di Irian Barat sesuai dengan praktek Indonesia, tetapi tidak sesuai dengan praktek Internasional.” Sementara, Duta Besar Pemerintah Gabon untuk PBB, Mr. Davin meragukan:” mengapa sangat banyak jumlah mayoritas wakil-wakil untuk perserta PEPERA diangkat oleh Pemerintah dan tidak dipilih oleh rakyat? (baca buku Socratez Sofyan Yoman: Orang Papua Bukan Separatis, Makar dan OPM, hal. 55, 75-78).

Dalam menggugat hasil PEPERA 1969 di Papua Barat, anggota Parlemen Inggris seperti Andrew Smith, MP, dan Lord Harries dari tahun ke tahun dan terus menerus mempengaruhi Anggota Parlemen Inggris dan Pemerintah Inggris. Desakan untuk meninjau kembali hasil PEPERA 1969 datang dari berbagai kelompok, dari kalangan LSM, akademisi, seniman, musisi, pelawak, dan dari anggota Parlemen dari berbagai Negara. Termasuk anggota parlemen Uni Eropa yang dimotori oleh Ibu Dr. Lucas Caroline, MEP. Andrew Smith dan kawan-kawan telah membentuk International Parliamentary for West Papua (IPWB) di London, Inggris, 15 Okotober 2008. Perjuangan untuk menggugat PEPERA 1969 terus ditingkatkan ke tingkat hukum, yaitu dibentuknya International Lawyer for West Papua (ILWP) pada tanggal 2-5 April 2009 di Guyana, Amerika Serikat.

Kegagalan PEPERA 1969 sudah terbukti dengan adanya UU No. 21 Tahun 2001 tentang Otonomi Khusus bahwa masalah status politik dan masa depan rakyat dan Bangsa Papua Barat belum final dan harus diselesaikan. Menurut Pemerintah Indonesia dan didukung oleh masyarakat internasional bahwa jalan solusi akhir dan konprehensip untuk masalah status politik Papua melalui UU No. 21 Tahun 2001 tentang Otonomi Khusus. Tetapi, Otsus sudah kacau balau dan gagal, bahkan menjadi malapetaka besar bagi orang asli Papua. Sebaliknya, yang lebih beruntung dan berhasil dalam era Otonomi Khusus di Papua adalah pembangunan infrastruktur keamanan dari pihak TNI dan POLRI yang lebih bagus di seluruh Tanah Papua, bahkan sampai di kampung-kampung. Bertambahnya jumlah pendatang yang terus meningkat tajam yang mengakibatkan meminggirkannya (memarjinalkan) penduduk asli di atas tanahnya sendiri. Pemekaran Provinsi dan kabupaten yang tidak terkendali sebagai bagian dari upaya operasi intelejen untuk pengembangan jaringan komunikasi dan pengkondisian wilayah Papua.”

Sebagai Gereja di Tanah Papua sangat prihatin dengan melihat dan mengalami bahwa ada usaha sistematis dan pembiaran untuk menghancurkan masa depan orang asli Papua oleh pemerintah Indonesia sejak 1 Mei 1963 sampai sekarang. Dengan jujur sebagai gereja kami menyampaikan bahwa Undang-Undang Otonomi Khusus No. 21 Tahun 2001 GAGAL DIIMPLEMENTASIKAN. Berdasarkan pengalaman yang memprihatinkan ini, Gereja-gereja di Tanah Papua menyampaikan keprihatinan kami kepada masyarakat Internasional supaya diambil langkah-langkah preventif untuk memproteksi dan menyelamatkan masa depan dan kelangsungan hidup umat Tuhan di Tanah Papua, terutama orang asli Papua di atas tanah mereka sendiri.”

“Di atas batu ini saya meletakkan peradaban orang Papua, sekalipun orang memiliki kepandaian tinggi, akal budi dan marifat tetapi tidak dapat memimpin bangsa ini, bangsa ini akan bangkit dan memimpin dirinya sendiri” ( Wasior, Manokwari, 25 Oktober 1925, Pdt. I.S. Kijne).

SOAL PAPUA, PUSAT TANGGUNG JAWAB

Jayapura- Ketua Umum Badan Pelayan Pusat Persekutuan Gereja-gereja Baptis Papua (BPP PGBP), Dumma Socratez Sofyan Yoman, dalam Press releasenya semalam kepada Pasifiic Post mengatakan, “Saudara Juwono Sudarsono, Menteri Pertahanan Keamanan (Menhan) melihat masalah Papua secara sempit dan parsial (cepos, Rabu, 17 Juni 2009). Pengibaran Bendera Bintang Kejora dikatakan dengan tujuan mencari perhatian bukan gerakan serius yang ingin melepaskan diri dari Republik Indonesia.”

Lanjutnya, yang menarik ialah dalam penyelesaian masalah Papua hanya dipersempit dengan pendekatan hukum dan dengan mengabaikan akar substansi yang lain. Ditambah lagi dengan melempar tanggungjawab pemerintah Pusat dengan mengatakan tanggungjawab utamanya ada di Pemda, kepolisian dan para bupati dan gubernurnya harus proaktif.

Demikian juga kepolisian harus melakukan pengamanan karena menaikan bendera itu tindakan yang melanggar hukum. Pemahaman seperti ini dapat dikategorikan pembelokkan masalah dan melempar tanggungjawab, maka pernyataan ini harus diperbaiki dan diluruskan. Karena, dalam era demokrasi, keterbukaan, dan kebebasan ini paradigma militer belum ada perubahan signifikan dan masih menggunakan pola Orde Baru (ORBA). Masing menggunakan sistim ancam-mengancam yang sudah tidak relevan dalam era ini.

Socratez menegaskan, yang harus diperbaiki dan diluruskan disini ialah pertama, masalah Papua adalah bukan masalah Pemda, bupati dan pihak kepolisian. Ini pemahaman yang keliru dan pembiasan (penggaburan) masalah yang sebenarnya. Kedua, Masalah Papua adalah persoalan yang berdimensi internasional. Karena dimasukkannya Papua ke dalam Indonesia adalah keterlibatan masyarakat Internasional. Jadi, termasuk Amerika, Belanda, dan lembaga Perserikatan Bangsa-Bangsa harus bertanggungjawab secara moril, hukum dan juga politik.

Ketiga, masalah Papua adalah masalah status politik dan status masalah hukum. Maka harus diselesaikan dengan pendekatan dialog politik dan juga pendekatan hukum. Kalau, pemerintah Indonesia melihat masalah Papua adalah masalah hukum maka pemerintah pusat harus proaktif, terbuka dan jujur mendukung proses hukum Internasional melalui lembaga yang baru saja dibentuk di Guyana, Amerika Serikat, tanggal 2-5 April 2009, yaitu International Lawyer for West Papua (ILWP) untuk melihat kembali Sejarah Pelaksanaan Penentuan Pendapat Rakyat (PEPERA) 1969.

Keempat, masalah Papua tidak relevan lagi diselesaikan dengan pendekatan kekuatan militer pada era moderen dan keterbukaan seperti sekarang ini. Sekarang saatnya berfikir kenyamanan manusia (human security) dan perlindungan martabat manusia (human integrity protection). Karena, era sekarang adalah era yang menjujung tinggi nilai keadilan, kesamaan derajat, hak asasi manusia, kebebasan, demokrasi dan penegakkan hukum. Bukan eranya lagi mengaku diri pahlawan, pelindung rakyat, penjaga kedaulatan negara. Prinsip hidup dan bernegara yang benar adalah menjaga integritas dan kenyamanan rakyat dan rakyat yang aman dan merasa dihargai, merekalah yang menjadi panglima, pahlawan dan pengawal negara dan bangsanya.

Kelima, masalah Papua itu masalah sejarah intergasi yang tidak benar. Masalah status politik rakyat Papua yang dikhianati, diabaikan dan dihilangkan. Masalah pelanggaran HAM yang sampai saat ini masih berlangsung. Masalah kegagalan pembangunan di Tanah Papua karena pembangunan di Tanah Papua dilaksanakan dengan penuh curiga dan pendekatan keamanan yang berlebihan. Karena itu, satu-satu jalan untuk menyelesaikan masalah Papua yang bermartabat, simpatik, bermoral ialah dialog damai antara rakyat Papua dan Pemerintah Indonesia yang dimediasi oleh pihak ketiga yang lebih netral.

Karena, jalan solusi akhir dan konprehensip melalui UU No. 21 Tahun 2001 tentang Otonomi Khusus, tetapi Otsus sudah kacau balau dan gagal, bahkan menjadi malapetaka besar bagi orang asli Papua. Sebaliknya, yang lebih beruntung dan berhasil dalam era Otonomi Khusus di Papua adalah pembangunan infrastruktur keamanan dari pihak TNI dan POLRI yang lebih bagus di seluruh Tanah Papua, bahkan sampai di kapung-kampung. Bertambahnya jumlah pendatang yang terus meningkat tajam yang mengakibatkan meminggirkannya (memarjinalkan) penduduk asli di atas tanahnya sendiri. Pemekaran Provinsi dan kabupaten yang tidak terkendali sebagai bagian dari upaya operasi intelejen untuk pengembangan jaringan komunikasi dan pengkondisian wilayah Papua.”

PENEMBAKAN DI PUNCAKA JAYA, SOCRATEZ NILAI REKAYASA

MENGAPA POLISI SELALU DI TEMBAK

Jayapura, Kasus tinginabut berdarah, penembakan yang menewaskan salah satu anggota brimob polda papua, Bripda Ahmad L. dibukit irimuli kabupaten puncka jaya di yakini sebagai upaya untuk memelihara konflik di tanah papua.

Penembakan anggota polisi di pengunungan papua bukan merupakan peristiwa penembakan yang pertama terjadi, hal ini patut menjadi perhatian semua komponen,pasalnya korban penembakan di daerah pedalaman papua selalu dialamatkan pada anggota palisi dan pelakunyapun hanya satu yakni TPN/OPM.

Tidak masuk akal daerah irimuni ini di kuasai oleh aparat TNI, mwngapa selama ini yang menjadi korban adalah anggota Polisi tapi bukan anggota TNI yang bertugas di daerah ini? Tanya Dumma Socratez Sofyan Yoman Ketua Badan Pelayan Pusat Persekutuan Gereja-Gereja Baptis Papua (BPP-PGBP) lewat pers releasnya kepada bitang papua.

Persekutuan Gereja Baptis papua kata, Dumma Socratez turut berduka atas tertembaknya salah satu anggota brimob Polda Papua di kabupaten puncak jaya.

Akan tetapi dengan situasi penembakan terhadap aparat jelas Dumma Socratez, situasi dan kondisi keamanan terhadap aktivitas rakyat sipil di daerah tersebut akan sangat memprihatinkan Dugaan pelaku dari kelompok Organisasi Papua Merdeka (OPM) akan menambah kaku aktivitas di daerah itu.

Gereja baptis juga sangat prihatin dengan situasi keamanan Umat Tuhan di tanah papua khusunya di puncak jaya. Menurut kami peristiwa penembakan anggota brimob di bikut irimuli bukan dilakukan oleh masyarakat yang selama ini di tuduh sebagai kelompok OPM, tegas Dumma Socratez.

Ia menilai peristiwa tersebut merupakan rekayasa yang di bangun untuk memelihara konflik di tanah papua. Pasalnya hingga saat ini OPM yang di sebut-sebut sebagai dalang dari semua peristiwa penembakan aparat merupakan orang kampong yang tidak terlatih secar khusus serta pengetahuan senjata yang minim bahkan tidak sama sekali.

Aparat keamana harus hentikan rekayasa daerah ini. Pertanyaanya dimana OPM belajar Teknik Menembak? Dimana OPM mendapat senjata dan peluru? Siapa OPM itu sebanarnya? Dimana kampong mana OPM itu tinggal? Apakah OPM itu berani dating mendekati Bukit irimuli dekat pos TNI? Ujarnya.

Returning OPM founder renounces independence

Nicolas Jouwe, cofounder of the Free Papua Movement (OPM) has arrived in Jakarta after 40 years exile in the Netherlands to renounce the restive province's indepen-dence struggle, officials here said Thursday.

The 84-year old Papuan figure fled to the Netherlands in the 1950s and has not returned to Indonesia until now.

He was said to have created the banned Morning Star flag for the rebel group.

Nicolas arrived Wednesday in Jakarta for talks with government leaders aimed at helping put an end to more than 40 years of hostility between the country and the OPM.

He will meet Coordinating Minister for People's Welfare Aburizal Bakrie on Friday and will travel to Papua soon.

"Nicolas Jouwe is the only OPM founding father who is still alive. He is intelligent and was fully committed to an independent Papua," Indonesian Ambassador to the Netherlands J.E. "Fany" Habibie said at a press conference here Thursday.

"He had refused to meet with Indonesian officials for dozens of years, but finally, he is willing to come to Indonesia. He even said he wants to be President Susilo Bambang Yudhoyono's adviser on Papua matters," he said.

Fany said Nicolas changed his stance after their meeting in the Netherlands, in which they were engaged in light and serious talks and even shared jokes and exchanged quatrains in the Ambonese language.

"I told him I didn't want Papua to be my neighbour, but I wanted it to be my family. I said the condition has changed now; there are schools, houses... The government has changed," Fany said.

He said Nicolas asked the central government to impose sanctions on local officials embezzling Papua's special autonomy funds.

Nicolas also called on OPM members to cease their separatist movement and support the unitary state of Indonesia.

"(I hereby) call all Papuan fighters in jungles and abroad to rebuild Papua within the frame of the Unitary Republic of Indonesia," Fany said, quoting a written statement from Nicolas.

However, this seemingly significant step toward peace for Papua is still fragile, the ambassador said, warning the government to handle this matter very carefully.

Fany held a meeting with Nicolas in late February, following the recent arrival of an Indonesian delegation to "lobby" the senior separatist leader in the Netherlands.

It was President Susilo Bambang Yudhoyono who sent the delegation after military operations have failed to stop the separatist fighting.

Aburizal's special assistant Rizal Mallarangeng said it was too early to expect the OPM to instantly halt its operations just because of Nicolas' renouncement.

He said Nicolas is not a structural leader of OPM, and the rebel group is not a solid organization.

"However, symbolically he still has a huge moral influence for OPM activists and at the international level. This will help us in international diplomacy," Rizal said.

He said Indonesia would try to convince Nicolas that development, and not independence, was the solution to combat poverty in Papua.

10 years sought for independence activist

Prosecutors told the district court in Jayapura, Papua, on Wednesday that pro-independence activist Bucthar Tabuni should be sentenced to 10 years imprisonment for alleged treason.

Buchtar, chairman of the International Parliamentarians for West Papua (IPWP), was arrested in Jayapura last December for leading a peaceful demonstration to support the launch of the IPWP in London.

The protest rally was held on Oct. 16, 2008 and was attended by hundreds of Papuans. The IPWP campaigns for the peaceful independence of West Papua from Indonesia and for the right to self-determination for local indigenous people.

Buchtar is now facing multiple criminal charges.

At the trial Thursday, Prosecutor Maskel Rambulangi told the court that Buchtar was guilty of violating Article 106 in the Criminal Code for an act of treason, Article 160 on provocation and Article 212 on acts against the state.

"When giving a speech during the demonstration, Bucthar Tabuni hinted at calling for separation *of Papua* from Indonesia, or the handover of part of Indonesia's territories to the foreign side," Maskel said.

"He also attempted to make this region sovereign, or independent," he added.

Responding to the charges, Buchtar directly consulted with his team of lawyers.

The panel of three judges, Manungku Prasetyo, Hotnar Simarmata and Lucky Rombot Kalala, adjourned the trial for a week to allow the defendant's lawyers to prepare their defense.

Iwan Niode, one of the lawyers, rejected the charges against Buchtar as "unrealistic", saying the prosecutors used "rubber articles" to indict his clients.

Such articles should have been scrapped because they could be used to attack anyone criticizing the government, Iwan argued.

These articles could also be manipulated to "suppress pro-democracy activists like Buchtar Tabuni", he added.

"Bucthar Tabuni just made a speech and raised an opinion *at the peaceful rally*."

"He did not hoist any flags, or carry any guns, let alone try and establish a separate state. Is he capable of that?

"I think the prosecutors falsely believe that Buchtar Tabuni is involved in an act of treason, to separate Papua from the unitary state of Indonesia, so they design indictments against him. It's unrealistic," Iwan said.

He urged the judges to avoid "co-optation" with the prosecutors, so they could do justice to his client.

"If outside Papua, people can freely raise their opinions, why is free speech still restrained in Papua, and treated as treason?

"It is an act of discrimination against Indonesian citizens," Iwan added.

Also on trial Wednesday was Bucthar's fellow Papuan activist, Sebby Sambom, who is facing similar charges for the same pro-independence demonstration.

Tuntutan 10 Tahun Untuk Buchtar Dinilai Kejam

JAYAPURA- Tuntutan 10 tahun penjara yang diajukan Jaksa Penuntut Umum (JPU) terhadap Buchtar Tabuni terdakwa kasus makar rupanya dipandang terlalu kejam bahkan dianggap sangat diskriminatif.
“Saya melihat tuntutan 10 tahun penjara untuk Buchtar itu sangat diskriminatif dan terlalu kejam,” ungkap Ir Weynand Watori pemerhati hukum dan HAM dan mantan Ketua Komisi F DPRP bidang hukum dan HAM kepada Cenderawsih Pos, Kamis (18/6).
Dalam kasus tersebut Buchtar menurutnya, hanya menyampaikan pendapat atau pikiran tetapi tuntutan dan apa yang dilakukannya tidak seimbang. Ia menilai hal itu sebagai bentuk kemunduran demokrasi di Indonesia dan tidak menghargai hak asasi. Sebab kata dia, orang hanya mengeluarkan pendapat tetapi justru dituntut 10 tahun penjara.
Fakta ini bahkan masih lebih buruk dibanding pada era 1960-an dan 1970-an sangat tidak adil jika terjadi diera reformasi seperti sekarang ini. “Karena kalau ini tuntutannya saja 10 tahun nanti akan diputuskan kurang dari 8 tahun,” ujarnya.
“Lama - lama orang sampaikan mimpi saja bisa dipenjara 2 tahun, ini terlalu over dalam tuntutan,” sambungnya.
Ia juga menilai hal itu sebagai upaya pembunuhan demokrasi di Indonesia, sebab sangat bertentangan dengan semangat bangsa ini untuk membangun demokrasi. Harusnya kata dia, orang yang melanggar amanat untuk membangun demokrasi di negara ini harusnya juga termasuk pelanggaran hukum dan harus dituntut karena terlalu sewenang–wenang dan melakukan yang tidak rasional.
“Jadi saya khawatir kalau kami sampaikan pendapat atau berbicara di depan seminar atau acara apa saja mungkin juga bisa dipenjara gara–gara itu. Bagi saya ini sebuah eksperimen yang sementara dilakukan pengadilan,” tuturnya.
Weynand menilai tuntutan jaksa itu sangat tidak rasional ia bahkan melihat hal itu sebagai suatu alarm tanda bahaya untuk kehidupan demokrasi di Papua. “Otsus sepertinya tidak dilihat, ini sama dengan model kolonial. Jaksa seperti itu harus diganti atau di laporkan kepada presiden karena sudah memberikan citra buruk orang Papua. 10 tahun itu terlalu arogan,” pungkasnya.(ta)

Prosecutors told the district court in Jayapura, Papua, on Wednesday that pro-independence activist Bucthar Tabuni should be sentenced to 10 years imprisonment for alleged treason.

Buchtar, chairman of the International Parliamentarians for West Papua (IPWP), was arrested in Jayapura last December for leading a peaceful demonstration to support the launch of the IPWP in London.

The protest rally was held on Oct. 16, 2008 and was attended by hundreds of Papuans. The IPWP campaigns for the peaceful independence of West Papua from Indonesia and for the right to self-determination for local indigenous people.

Buchtar is now facing multiple criminal charges.

At the trial Thursday, Prosecutor Maskel Rambulangi told the court that Buchtar was guilty of violating Article 106 in the Criminal Code for an act of treason, Article 160 on provocation and Article 212 on acts against the state.

"When giving a speech during the demonstration, Bucthar Tabuni hinted at calling for separation *of Papua* from Indonesia, or the handover of part of Indonesia's territories to the foreign side," Maskel said.

"He also attempted to make this region sovereign, or independent," he added.

Responding to the charges, Buchtar directly consulted with his team of lawyers.

The panel of three judges, Manungku Prasetyo, Hotnar Simarmata and Lucky Rombot Kalala, adjourned the trial for a week to allow the defendant's lawyers to prepare their defense.

Iwan Niode, one of the lawyers, rejected the charges against Buchtar as "unrealistic", saying the prosecutors used "rubber articles" to indict his clients.

Such articles should have been scrapped because they could be used to attack anyone criticizing the government, Iwan argued.

These articles could also be manipulated to "suppress pro-democracy activists like Buchtar Tabuni", he added.

"Bucthar Tabuni just made a speech and raised an opinion *at the peaceful rally*."

"He did not hoist any flags, or carry any guns, let alone try and establish a separate state. Is he capable of that?

"I think the prosecutors falsely believe that Buchtar Tabuni is involved in an act of treason, to separate Papua from the unitary state of Indonesia, so they design indictments against him. It's unrealistic," Iwan said.

He urged the judges to avoid "co-optation" with the prosecutors, so they could do justice to his client.

"If outside Papua, people can freely raise their opinions, why is free speech still restrained in Papua, and treated as treason?

"It is an act of discrimination against Indonesian citizens," Iwan added.

Also on trial Wednesday was Bucthar's fellow Papuan activist, Sebby Sambom, who is facing similar charges for the same pro-independence demonstration.

Government Should Investigate Abusive Prison Guards

(New York) - The Indonesian government should investigate and hold accountable abusive guards and officials at the Abepura prison in Papua, Human Rights Watch said today. Various sources report that torture, beatings, and mistreatment by guards are rampant. Abepura holds approximately 230 prisoners, of whom more than a dozen are imprisoned for peaceful political acts.

"How can the government turn a blind eye to beatings and torture
in one of its prisons?" said Brad Adams, Asia director at Human
Rights Watch. "Jakarta needs to put an end to this disgraceful
behavior, punish those responsible, and start keeping a close
eye on what is happening there."

Human Rights Watch has received reports of more than two dozen
cases of beatings and physical abuse since Anthonius Ayorbaba, a
Papuan civil servant who previously worked in the Jayapura
office of the Ministry of Law and Human Rights, became the
prison warden in August 2008. As prison warden, Ayorbaba is the
most senior prison official in Abepura. The administration of
prisons falls under the Ministry of Law and Human Rights.

Human Rights Watch said that the Indonesian government should
replace the prison administration and open the prison to
international monitoring. Foreign human rights monitors and
foreign journalists require special police permission to enter
Papua province and are unable to carry out independent research
there. Human Rights Watch also urged President Susilo Bambang
Yudhoyono to set up an independent team to investigate abuses in
Abepura prison.

Incidents of Abuse

In one case, on September 22, 2008, prison guards took political
prisoner Ferdinand Pakage to the prison security office at
around 8 a.m. The prison's security chief hit Pakage with a
rubber club six times in the head. A guard hit Pakage with his
bare hand, while the chief repeatedly kicked Pakage with his
boot. Another guard, Herbert Toam, punched Pakage's head while
holding a lock and key, which penetrated Pakage's right eye.
Guards threw Pakage into an isolation cell unconscious at around
8:20 a.m. At 2 p.m., prison guards brought Pakage to the Abepura
hospital, but the hospital was closed. Only on September 23 did
doctors examine Pakage at Dock Dua hospital in Jayapura. It was
too late to save his right eye, as the bleeding was too severe.

Ayorbaba wrote an undated chronology of the case, obtained by
Human Rights Watch, which described the beating by Toam. It
states that the severe injury inflicted was an accident,
claiming that Toam hit Pakage without realizing that the key was
still in the lock. It also claimed that Pakage had previously
threatened a prison guard. The report does not mention the role
of two other prison guards in the attack.

In December 2008, Ayorbaba told Human Rights Watch that the
report had been submitted to the Ministry of Law and Human
Rights as well as the National Commission on Human Rights
(Komnas Ham), and that "Herbert is very likely to be fired."
Ayorbaba said he had advised Toam to take a leave of absence
from work and settle the case through traditional means,
involving negotiations with Pakage's clan. Toam did not go to
work between October 2008 and March 2009, though he continued to
draw his monthly salary. He failed to settle the case through
traditional means and returned to work in April.

Neither the Ministry of Law and Human Rights nor Komnas Ham
appear to have conducted any investigation into this matter. In
October, Pakage's family tried to report the case to the
Jayapura police, but the police refused to file the case,
suggesting that the family could settle the case with the
Ministry of Law and Human Rights. The family orally lodged a
complaint with the ministry. In October, the Office of Justice,
Peace and Integrity of Creation (KPKC), a religious group, wrote
to the Ministry of Law and Human Rights office complaining about
various cases of abuse, including Pakage's case, but there has
been no follow-up.

In another case, on February 26, 2009, Abepura prison officials
discovered that Buchtar Tabuni, a detained student leader, had a
mobile phone in his pocket. According to Tabuni, prison guard
Andrianus Sihombing hit Tabuni in his eye, causing it to bleed.
Prison guards temporarily moved Tabuni to the Jayapura police
detention center, apparently so that Indonesia's law and human
rights minister, Andi Mattalatta, would not see the wound while
making a planned inspection of the prison the next day. After
Mattalatta left Papua, guards returned Tabuni to Abepura prison.

On March 1, 2009, Yusak Pakage, another political prisoner who
is related to Ferdinand, asked Sihombing why he had beaten
Tabuni. Sihombing responded by hitting Pakage in the face,
breaking his glasses and cutting his forehead. Several prisoners
intervened to defend Pakage. That night, led by Warden Ayorbaba,
guards moved eight prisoners, including Pakage and a student
leader, Selphius Bobbi, into a small isolation cell, where they
were kept for three nights. The guards reportedly beat Bobbi.
Other guards entered detention blocks and beat many prisoners
indiscriminately, witnesses said. Witnesses told Human Rights
Watch that some of the guards appeared to be drunk.

Guards also reportedly beat with iron bars two prisoners who had
delivered water and food to Pakage while on kitchen duty,
unaware of an apparent order not to feed him.

On May 11, a guard beat a prisoner for possessing a mobile
phone, causing severe bleeding from his left ear. As a result,
the prisoner lost partial hearing in that ear. According to
witnesses, the same guard beat two other prisoners who had used
the mobile phone. The guard forced one of the prisoners to put
his hand into boiling water. The identity of some of those
making the reports is being kept confidential to protect them
from retribution.

Efforts to Lodge Complaints Fruitless

Indonesia's Rehabilitation Law No. 12/1995 sets out procedures
for prisoners to complain about mistreatment in prison.
Prisoners are to report abusive guards to the prison warden. If
the warden is involved, they can report the case to the
provincial office of the Ministry of Law and Human Rights in
Jayapura. In such cases, criminal action can be brought against
the officials involved, and the prisoners are entitled to legal
representation.

Prior to Ayorbaba's posting as warden, prisoners and their
relatives often reported abuse by guards to the Ministry of Law
and Human Rights, but no action was ever taken. Prisoners say
they have stopped reporting abuses because they lack faith in
the system, and because Ayorbaba had worked in that office
before his promotion so they feared retribution if they spoke
out.

Ministry of Law and Human Rights inspectors from Jakarta are
required to inspect prisons regularly. In practice, prisoners
and a prison guard told Human Rights Watch, the inspectors
usually just meet with the warden. Prisoners have no opportunity
to meet or discuss any issues with prison inspectors from
Jakarta.

Since August 2008, informal leaders among the prisoners at
Abepura had requested a meeting with Ayorbaba, but he had
refused. In December 2008, Yusak Pakage, one of the leaders, had
a chance to talk with Ayorbaba when he visited a hospital where
Pakage was being treated for an illness. At that meeting,
Ayorbaba declined to talk about abuses and did not take the
complaints seriously.

"The Indonesian government needs to replace the Abepura prison
management," said Adams. "But this is not just a failure of one
prison warden. It's a failure of Jakarta to set proper standards
and enforce them."

In March, the Indonesian Foreign Ministry ordered the
International Committee of the Red Cross (ICRC) to close its
field offices in Jayapura and Banda Aceh. The ICRC ran
sanitation projects in Papua and also visited detainees,
including political prisoners, in Abepura prison. Indonesian
Foreign Ministry spokesperson Teuku Faizasyah denied that the
closure had anything to do with the ICRC's visits to Papuan
prisons, including Abepura, saying that it was merely a
regulatory measure.

Human Rights Watch said that international monitors such as the
ICRC and independent human rights groups should be able to visit
prisoners in Abepura to investigate reports of abuse, given the
ministry does not appear to be protecting the interests of
prisoners or responding to grievances.

"These prisoners have exhausted all avenues to fight for their
rights, but officials refuse to listen," said Adams. "Given the
scale of abuses, the Indonesian government should open Papuan
prisons to international monitoring."

Indonesia told to stop prison brutality in Papua

Indonesia should investigate allegations of prison brutality in
insurgency-wracked Papua province, a rights group said Friday,
citing rampant reports of torture, beatings and mistreatment by
guards.

The government "needs to put an end to this disgraceful
behavior, punish those responsible," Brad Adams, Asia director
at Human Rights Watch, said.

The Abepura Prison holds about 230 inmates, more than a dozen of
whom were jailed for peaceful political acts, such as
participating in anti-government demonstrations and waving the
flag of the small separatist movement.

The government – which is extremely sensitive to secessionist
threats, no matter how small – bars foreign human rights
monitors and foreign journalists from entering Papua unless they
have special police permission, and prohibits them from carrying
out research.

In March, the Red Cross was ordered to leave the easternmost
province after its workers visited several suspected rebels in
prison.

Officials with the Ministry of Justice and Human Rights, which
overseas prisons, could not be reached for comment Friday. And
prison warden Anthonius Ayorbaba told The Associated Press "I
can't talk about it now."

The New York-based rights group said it had received more than
two dozen reports of beatings and physical abuse in the last
year, including a Sept. 22, 2008 attack on one of the political
prisoners, Ferdinand Pakage that caused him to lose an eye.

"The prison's security chief hit the prisoner with a rubber club
six times on the head," the rights group wrote in a statement
Friday. It said that two other guards pummeled him until he was
unconscious, one while holding a key that penetrated his right
eye.

The inmate was thrown into an isolation cell, it said, and
waited more than 24 hours to get medical help.

The rights group detailed several other cases of abuse,
including an attack on a prisoner for possessing a mobile phone,
causing his left ear to bleed and resulting in partial hearing
loss. Another guard forced an inmate to put his hand into
boiling water, the group said.

Adams urged President Susilo Bambang Yudhoyono to set up an
independent team to investigate the abuses.

Indonesia took over Papua from the Dutch in 1963 and formalized
its sovereignty over the region six years later through a
stage-managed vote by about 1,000 community leaders.

A small insurgency has battled Indonesian rule in the
impoverished province ever since. About 100,000 Papuans – a
sixth of the population – have died in military operations.
