Lanjutnya, kami  meminta kepada LSM - LSM lokal yang ada di Papua agar tidak berputus asa memberikan informasi yang sedang berkembang di Papua kepada pihak Kedubes AS.

US JAKARAT,-- Sumarry: Indonesia merupakan negara demokrasi dengan multi-partai. Tahun 2009, pemberi suara memilih Susilo Bambang Yudhoyono kembali sebagai Presiden dalam pemilihan umum yang bebas dan jujur. Pengamat dalam dan luar negeri menilai bahwa pemilihan umum legislatif 2009 juga bebas dan jujur. Setelah lebih dari 10 tahun reformasi demokrasi, pasukan keamanan melapor ke pihak berwenang sipil; namun, ada beberapa contoh pengecualian ketika beberapa unsur pasukan keamanan bertindak sepihak dalam mengendalikan warga sipil.

Penekanan atau pelanggaran terhadap hak beribadah dan kaum etnis minoritas merupakan sebuah masalah. Pemerintah memberlakukan UU makar dan penistaan agama untuk membatasi kebebasan berekspresi para pendukung kemerdekaan damai di provinsi Papua, Papua Barat, dan Maluku serta oleh kelompok agama minoritas. Pejabat yang korupsi, termasuk di jajaran pengadilan, merupakan masalah besar.
Permasalahan hak asasi lainnya termasuk pembunuhan oleh pasukan keamanan, pelecehan terhadap para narapidana dan tahanan, kondisi penjara yang buruk, perdagangan manusia, pekerja anak, dan gagal menegakkan standar buruh dan hak pekerja.

    Dalam Laporan itu ada pengguraian rilis Papua:

    Perampasan Hak Hidup Sewenang-Wenang atau Melanggar Hukum

    Ada sejumlah laporan bahwa oknum aparat keamanan  baik tentara maupun polisi melakukan pembunuhan sewenang-wenang atau melanggar hukum selama tahun 2012. 

    Pada 14 Juni, anggota pasukan keamanan yang tidak bisa teridentifikasi di Jayapura, Papua menembak mati Mako Tabuni, pemimpin Komite Nasional untuk Papua Barat (KNPB), yang berkampanye untuk mendapatkan kebebasan menentukan nasib sendiri bagi provinsi Papua dan Papua Barat. Perihal penyebab kematian Tabuni tetap belum jelas, pihak kepolisian menegaskan bahwa Tabuni tertembak karena menolak penangkapan, sementara para pembela hak asasi manusia menyatakan bahwa ia ditembak dari belakang saat mencoba melarikan diri. Dicurigai Tabuni menjadi target percobaan pembunuhan oleh pemerintah yang membunuh aktivis mahasiswa Terjoli Weya tanggal 1 Mei. Pelaku misterius menembak Weya saat demonstrasi memperingati perpindahan Papua dan Papua Barat dari Belanda ke Indonesia pada tahun 1963. Saat penembakan, Weya dilaporkan sedang berdiri bersama Tabuni di bagian belakang truk sewaktu melewati markas militer Abepura. Beberapa anggota KNPB dan aktivis mengklaim bahwa Weya ditembak dari markas, dan otopsi mengungkapkan bahwa ia diserang oleh pecahan kaliber .22. Polisi tidak menginvestigasi kasusnya.

    Pada 27 Juli, anggota Brigade Mobil Polisi (Brimob) Polda Sumatera Selatan membubarkan demonstrasi warga Desa Limbang Jaya, Kabupaten Ogan Ilir di Sumatera Selatan. Komisi Nasional Hak Asasi Manusia (Komnas HAM) menemukan bahwa personil Brimob menembak Angga Prima yang berusia 12 tahun saat mereka berusaha mencegah terjadinya demonstrasi. Komnas HAM juga menemukan bukti bahwa Kapolda Sumatera Selatan memerintahkan Brimob untuk melakukan "langkah-langkah represif" dalam menangani warga setempat di Ogan Ilir. Sengketa klaim hak atas tanah yang terjadi antara warga dengan  perusahaan perkebunan milik pemerintah, PT. Perkebunan Nusantara (PTPN) VII Cinta Manis merupakan penyebab timbulnya konflik berdarah . Penyelidik Polri telah meminta keterangan 120 anggota Brimob yang terlibat dalam bentrokan, tapi tidak ada satu pun yang ditangkap atau ditindak. 

    Kekerasan yang terus berlangsung telah menyengsarakan warga masyarakat di provinsi Papua dan Papua Barat selama tahun tersebut. Keterpencilan wilayah membuatnya sulit untuk mengkonfirmasikan laporan mengenai desa-desa yang terbakar dan kematian warga sipil. Pada 6 Juni, menyusul insiden di Wamena yaitu seorang anak terluka dalam kecelakaan lalu lintas yang melibatkan dua tentara dari Batalyon Infanteri 756 bersepeda motor, warga setempat menyerang kedua tentara yang mengakibatkan Pratu Ahmad Sahlan terbunuh sedangkan Sersan Parloi Pardede terluka parah. Sebagai reaksi balas dendam atas kematian dan terlukanya rekan mereka sekitar50-100 anggota batalyon melakukan penyerangan  yang mengakibatkan Elinus Yoman terbunuh, melukai sejumlah warga setempat, 87 rumah terbakar. Hingga akhir tahun, penguasa tidak menahan atau memberikan tindakan indisipliner pada anggota Batalyon Infanteri 756 atas peran mereka di insiden tersebrgaut. Angkatan Darat Indonesia mengklaim bahwa tentara mereka harus membela diri saat berusaha mengambil jasad Sahlan. Beberapa hari berikutnya setelah kejadian, upacara rekonsiliasi khusus dilaksanakan yang melibatkan warga setempat, pejabat sipil dan pasukan keamanan. 

    Banyak kekerasan di Papua dan Papua Barat berkaitan dengan Organisasi Papua Merdeka (OPM) dan operasi pasukan keamanan melawan OPM. Sebagai contoh, pada 23 Agustus, polisi menahan empat orang yang diduga keras anggota OPM sebagai tersangka pembunuhan anggota polisi Yohan Kasimatau di Bandara Enarotali di Paniai pada tanggal 21 Agustus. 

    Selain pembunuhan oleh pasukan keamanan dan OPM, terdapat juga sejumlah insiden kekerasan, termasuk beberapa pembunuhan oleh pihak-pihak yang tidak dikenal di Papua dan Papua Barat. Penyerang misterius yang oleh pejabat pemerintahan dan kontak HAM di duga dilakukan oleh pihak a separatis Papua, membunuh beberapa warga pendatang non-Papua. Pada 22 Mei, pengemudi Syaiful Bahri meninggal di tangan seorang pembunuh misterius. Polisi menemukan serpihan jasadnya yang hangus terbakar di dalam mobil sewaan di pemakaman di Jayapura, Papua. Otopsi mengungkapkan bahwa pendatang dari Jawa tersebut kemungkinan besar meninggal setelah ditusuk berulang kali.

    Kejahatan terus terjadi di sepanjang jalan dekat pertambangan emas dan tembaga Grasberg milik Freeport McMoran di Timika, Papua, termasuk pembunuhan pasukan keamanan dan pekerja. Pada 9 Januari, penembak misterius membunuh dua pekerja PT. Kuala Pelabuhan Indonesia, perusahaan kontraktor Freeport, di sepanjang jalan. Polisi menemukan jasad mereka di kendaraan yang terbakar. Pada 7 Februari, di titik lain di jalanan tersebut personil Brimob Ronald Sopamena diduga ditembak mati oleh pihak OPM. 

    Pada Juni 2011, Mahkamah Agung menolak kasasi Pollycarpus Budihari Priyanto, yang sebelumnya dihukum tahun 2004 karena didakwa meracuni yang mengakibatkan kematian aktivis HAM, Munir Said Thalib. Sedangkan para pembela HAM terus menduga bahwa peracunan yang mengakibatkan kematian Munir melibatkan anggota Badan Intellijen Nasional (BIN). Pengungkapan keterlibatan personel intelijen BIN dalam kematian Munir oleh pihak kejaksaan tampaknya tidak mengalami kemajuan dan cenderung berjalan ditempat.

    b. Penghilangan Orang

    Tidak ada laporan mengenai penghilangan orang bermotif politik selama tahun tersebut. Pemerintah dan organisasi masyarakat sipil melaporkan sedikit perkembangan dalam menghitung orang hilang tahun lalu atau dalam menuntut mereka yang bertanggung jawab terhadap hilangnya orang-orang tersebut. 

    Tahun 2009, Dewan Perwakilan Rakyat (DPR) menyetujui pembentukan pengadilan ad hoc untuk melanjutkan penyelidikan dan kemungkinan penuntutan terhadap penculikan aktivis pro-demokrasi tahun 1998. Pada akhir tahun, pemerintah belum membentuk pengadilan ad hoc yang dimaksud.

US seeks expanded military ties with Indonesia

WASHINGTON (AP) — A senior U.S. official says Washington should expand its military ties with Indonesia, befitting a relationship between two robust democracies.


Top diplomat for East Asia, Kurt Campbell, said those ties have grown in recent years, but not fast enough.

Campbell was speaking Tuesday at a gathering of the U.S.-Indonesia Society in Washington.
The U.S. severed military ties for several years after of Indonesia’s bloody crackdown in East Timor in 1999. Jakarta has since sought to professionalize and modernize its military. Key U.S. restrictions on engagement with Indonesia’s feared special forces were lifted in 2010.

Human rights groups say Indonesia’s military abuse continues, particularly in the restive province of west Papua.

Campbell also advocated deeper ties between the two governments and praised Jakarta’s leadership in regional diplomacy

The West Papua Advocacy Team respectfully requests that you raise the following concerns in your upcoming meetings with Indonesian officials during your visit to Jakarta:


The Killing of Mako Tabuni

On June 14 in West Papua, Government of Indonesia security elements shot and killed Mako Tabuni, a prominent Papuan human rights advocate. According to eyewitnesses, Mr. Tabuni was shot by plainclothes officers after he eluded their attempts to force him into an unmarked vehicle. Although he was badly wounded, the plainclothes officers failed to take him to a nearby hospital and instead brought him to a distant police facility where he died. The appearance and modus operandi of the security officials strongly suggest that they were members of the U.S.-funded "Detachment 88." This unit has been accused of human rights violations in West Papua and elsewhere by reputable human rights organizations.
 
The issue of impunity continues to prevail in Indonesia and Timor-Leste because the authorities of the two governments only want to improve diplomatic relationships and have neglected the human rights violations that occurred during the Indonesian occupation.

We strongly urge you to insist that the Government of Indonesia conduct a thorough and transparent investigation of the killing of Mako Tabuni.


Military Operations Impacting Civilians

For decades the Government of Indonesia has conducted military operations in remote areas of West Papua purportedly aimed at countering the activity of the small, lightly-armed Papua Freedom Movement (OPM). These operations have severely affected local civilians resulting in the destruction of homes, places of worship and public buildings, and causing the flight of civilians to nearby forests where they face life threatening conditions. Invariably, security forces impede efforts by humanitarian relief organizations to assist these displaced civilians. Many civilians have died as a result of these military operations. Currently such an operation is underway in the Paniai region.


We strongly urge you to call on the Government of Indonesia to cease resort to armed measures to address largely peaceful Papuan protests and to permit humanitarian relief organizations to respond to the urgent human need generated by these military operations.


Provision of Vital Human Services to Papuans

Since assuming control of West Papua through the widely discredited "Act of Free Choice" over 40 decades ago, the Government of Indonesia has consistently failed to provide minimally adequate health, education and other vital services to the Papuan people. That failure has resulted in health and education indices for the Papuan population that are consistently among the lowest in Indonesia and the region and have prompted charges that Jakarta's malign neglect of the Papuan people's basic human needs amounts to genocide.


We strongly urge that you press the Government of Indonesia to address the dearth of human services in West Papua and that the U.S. Government increase its own assistance, particularly in the areas of health, education and creation of employment opportunities for the systematically-marginalized Papuans.


Papuan Political Prisoners

Human rights organizations such as Amnesty International and Human Rights Watch have repeatedly accused the Government of Indonesia of incarcerating Papuans for peaceful activities protected under international covenants assuring the right to peaceful political activity and the right to assembly. Moreover, these organizations and a 2007 report by a UN Special Rapporteur determined that conditions of incarceration for these (and other) prisoners and detainees do not meet minimal international standards. Recently, Papuan political prisoner (and Amnesty International Prisoner of Conscience) Filep Karma has suffered delays in the provision of crucial medical services guaranteed him under international covenants to which Indonesia is a signatory party.


We strongly urge you to raise with Indonesian officials concern over the continued persecution of peaceful dissent by Papuans and their mistreatment when in custody, including the Indonesian government's failure to provide minimally adequate medical care as required under international law.


U.S. Sale of Attack Helicopters to Indonesia

In March of this year, 90 international NGO's urged the U.S. not to sell AH-64 Apache attack helicopters to Indonesia. These organizations argued that provision of these helicopters would pose a direct threat to Papuan civilians, who have suffered deadly TNI (Indonesian military) assaults for many years. Specifically, the NGO's noted that the heavily-armed AH-64 was a highly lethal weapon which could be used to escalate conflict within Indonesia and in West Papua as these aircraft would substantially augment the TNI's capacity to prosecute its "sweep operations" in West Papua. The consequence of this augmentation of the TNI arsenal would lead to increased suffering among the civilian populations long victimized by such operations.


We again urge that the U.S. government not approve the sale of this weapon system to the Indonesian military and that you use the occasion of your visit to inform the Indonesians that the sale will not go forward.


Calls for Government of Indonesia-Papuan Dialogue

Respected Papuan leaders have long called on the Government of Indonesia to engage in an internationally mediated dialogue with the Papuan people regarding the future of West Papua. At the July 2011 "Papua Peace Conference" which convened in Jayapura with more than 1,000 in attendance, Papuan representatives were selected for such a dialogue. The Indonesian Government observed this conference at the ministerial level.


Welcoming past U.S. Government support for a dialogue, we urge you to reiterate U.S. Government encouragement for such a dialogue.

Since assuming control of West Papua through the widely discredited "Act of Free Choice" over 40 decades ago, the Government of Indonesia has consistently failed to provide minimally adequate health, education and other vital services to the Papuan people. That failure has resulted in health and education indices for the Papuan population that are consistently among the lowest in Indonesia and the region and have prompted charges that Jakarta's malign neglect of the Papuan people's basic human needs amounts to genocide.


We strongly urge that you press the Government of Indonesia to address the dearth of human services in West Papua and that the U.S. Government increase its own assistance, particularly in the areas of health, education and creation of employment opportunities for the systematically-marginalized Papuans.


Papuan Political Prisoners

Human rights organizations such as Amnesty International and Human Rights Watch have repeatedly accused the Government of Indonesia of incarcerating Papuans for peaceful activities protected under international covenants assuring the right to peaceful political activity and the right to assembly. Moreover, these organizations and a 2007 report by a UN Special Rapporteur determined that conditions of incarceration for these (and other) prisoners and detainees do not meet minimal international standards. Recently, Papuan political prisoner (and Amnesty International Prisoner of Conscience) Filep Karma has suffered delays in the provision of crucial medical services guaranteed him under international covenants to which Indonesia is a signatory party.


We strongly urge you to raise with Indonesian officials concern over the continued persecution of peaceful dissent by Papuans and their mistreatment when in custody, including the Indonesian government's failure to provide minimally adequate medical care as required under international law.


U.S. Sale of Attack Helicopters to Indonesia

In March of this year, 90 international NGO's urged the U.S. not to sell AH-64 Apache attack helicopters to Indonesia. These organizations argued that provision of these helicopters would pose a direct threat to Papuan civilians, who have suffered deadly TNI (Indonesian military) assaults for many years. Specifically, the NGO's noted that the heavily-armed AH-64 was a highly lethal weapon which could be used to escalate conflict within Indonesia and in West Papua as these aircraft would substantially augment the TNI's capacity to prosecute its "sweep operations" in West Papua. The consequence of this augmentation of the TNI arsenal would lead to increased suffering among the civilian populations long victimized by such operations.


We again urge that the U.S. government not approve the sale of this weapon system to the Indonesian military and that you use the occasion of your visit to inform the Indonesians that the sale will not go forward.


Calls for Government of Indonesia-Papuan Dialogue

Respected Papuan leaders have long called on the Government of Indonesia to engage in an internationally mediated dialogue with the Papuan people regarding the future of West Papua. At the July 2011 "Papua Peace Conference" which convened in Jayapura with more than 1,000 in attendance, Papuan representatives were selected for such a dialogue. The Indonesian Government observed this conference at the ministerial level.


Welcoming past U.S. Government support for a dialogue, we urge you to reiterate U.S. Government encouragement for such a dialogue.

US State Department urges proper investigation into Papua shootings

The US State Department has condemned recent violence in Indonesia’s Papua region and urged Jakarta to investigate allegations of excessive force by the security forces.

The State Department says it wants to see full and transparent investigations into a recent string of shootings in Papua, most of which have been blamed by police on "unidentified gunmen".

The Huffington Post reports that at least 19 people have been killed in Papua over the last month.
In the killing of the Papuan leader Mako Tabuni last month in Jayapura, police say an officer was forced to shoot him when he resisted arrest.

His death came shortly after he publicly called for police to properly investigate recent shootings.
The US State Department says that limitations on access to Papua for foreign governments, NGOs and journalists only feeds suspicion in the international community about government actions in the region.
It has encouraged Indonesia to take this into consideration when reviewing travel requests.

Pendahuluan Indonesia adalah negara demokrasi multipartai. Pada tahun 2009 Susilo Bambang Yudhoyono terpilih kembali presiden pada pemilihan umum yang bebas dan adil. Pemantau domestik dan internasional menilai pemilu 2009 legislatif yang bebas dan adil juga. Pasukan keamanan dilaporkan kepada otoritas sipil.
Mayor masalah HAM termasuk kasus pembunuhan sewenang-wenang dan tidak sah oleh pasukan keamanan dan lainnya di Papua dan Papua Barat, pelecehan sosial terhadap kelompok minoritas tertentu agama, dan Pembatasan hak-hak minoritas agama tertentu untuk secara bebas menjalankan agama mereka dengan pemerintah regional dan lokal . Korupsi pejabat, termasuk dalam peradilan, merupakan masalah utama, meskipun Komisi Pemberantasan Korupsi (KPK) telah mengambil beberapa langkah konkret untuk mengatasi ini.
HAM lainnya termasuk masalah: kadang-kadang kondisi penjara yang keras; beberapa keterbatasan yang sempit dan spesifik tentang kebebasan berekspresi; perdagangan orang; pekerja anak, dan kegagalan untuk menerapkan standar perburuhan dan hak pekerja.

Gerilyawan separatis di Papua membunuh anggota pasukan keamanan dalam beberapa serangan dan lainnya terluka. Aktor nonpemerintah terlibat dalam kekerasan politik terkait, termasuk pembunuhan, di Provinsi Aceh.

Bagian 1. Menghormati atas Integritas Pribadi, Termasuk Kebebasan dari:

a. Sewenang-wenang atau Melanggar Hukum Perampasan Hidup
Pemerintah atau para aparatnya tidak melakukan pembunuhan politik, namun, keamanan personil kekuatan membunuh beberapa penjahat dan teroris yang diduga dalam perjalanan menangkap mereka. Selain itu, ada sejumlah laporan menuduh pasukan keamanan dari penggunaan kekuatan yang berlebihan menyebabkan kematian, terutama ketika menangani protes. Pada tanggal 19 Oktober, polisi dan unit militer tersebar peserta Rakyat Papua Ketiga, AOS Kongres di Jayapura, Papua. Nasional Indonesia Komisi Hak Asasi Manusia (Komnas HAM) menemukan bahwa Demananus Daniel, Yakobus Samsabara, dan Max Asa Yeuw, yang mati mayat ditemukan di dekat daerah Kongres, ditembak. Komnas HAM meminta penyelidikan (lihat bagian 2.b.). Dalam insiden lain, pada tanggal 24 Desember, polisi menembaki demonstran di Pulau Bima, Nusa Tenggara Barat, menewaskan dua dan melukai 14.
Pada tanggal 31 Maret, Sersan Sukirman dan First Inspektur Jefry Pantouw dari Biau Kepolisian Precinct dituduh penyalahgunaan sehubungan dengan kematian Agustus 2010 Kasmir Timumun dalam tahanan polisi di Buol, Sulawesi Tengah. Polisi awalnya melaporkan bahwa Timumun bunuh diri, tetapi organisasi non pemerintah yang kredibel (LSM) sumber melaporkan bahwa tubuhnya menanggung bukti penyalahgunaan. Pada tanggal 24 September, kedua petugas dihukum karena penyiksaan oleh Sulawesi Tengah Pengadilan dan dijatuhi hukuman satu tahun penjara. Jaksa mengajukan banding, mencari kalimat yang lebih panjang. Jaksa juga mengajukan tuntutan terhadap petugas ketiga, Amirullah Haruna, karena diduga menembak Mangge Ikhsan selama kerusuhan protes yang diikuti Timumun, kematian AOS. Haruna dinyatakan tidak bersalah dan dibebaskan pada 27 Oktober.
Kekerasan terjadi di provinsi Papua dan Papua Barat sepanjang tahun. Karena terpencilnya daerah tersebut sulit untuk mengkonfirmasi laporan dari desa-desa terbakar dan kematian sipil. Banyak dari kekerasan ini dihubungkan dengan Organisasi Papua Merdeka (OPM) dan operasi pasukan keamanan melawan OPM. Misalnya, pasukan OPM melukai tiga tentara dalam pertukaran 5 Juli api. Dalam insiden lain pada tanggal 12 Juli penyerang, yang pemerintah diduga adalah OPM yang berafiliasi, melukai empat tentara dan dua warga sipil. Pada tanggal 24 Oktober diduga OPM yang berafiliasi penyerang menembak dan membunuh kepala kantor polisi Mulia.
Setelah penyelidikan militer, tiga tentara dari Batalyon Infanteri 753 menghadapi pengadilan militer atas pembunuhan 2010 Maret Pendeta Kinderman Gire di Puncak Jaya, Papua. Pada tanggal 11 Agustus, pengadilan menjatuhkan hukuman Swasta Herry Purwanto, Sersan Saut Sihombing, dan Hasirun Swasta sampai 15, tujuh, dan enam bulan penjara masing-masing untuk tidak mematuhi perintah yang sah. Para prajurit tidak dikenakan biaya dengan kejahatan yang lebih serius penyerangan atau pembunuhan. Penyelidikan militer dan pengadilan dilaporkan tidak memperhitungkan akun non militer kesaksian atau bukti.
Selain pembunuhan oleh pasukan keamanan dan OPM, ada sejumlah insiden kekerasan, termasuk beberapa pembunuhan oleh pihak tak dikenal di Papua dan Papua Barat. Penyerang tidak dikenal yang dilakukan sejumlah penembakan dan pembunuhan di sepanjang jalan dekat McMoRan Freeport, Aos (Freeport, AOS) Indonesia yang dioperasikan Grasberg emas dan tembaga di Timika, Papua, menewaskan pasukan keamanan, karyawan Freeport, dan warga sipil setempat. Misalnya, dalam serangan 7 April, para penyerang tak dikenal bersenjata membunuh dua petugas keamanan Freeport. Pada tanggal 14 Oktober penyerang tak dikenal menewaskan tiga pekerja Freeport dan membakar kendaraan mereka.
Pada bulan Juni Pollycarpus Budihari Priyanto, yang sebelumnya dihukum dalam keracunan 2004 dari aktivis HAM Munir Said Thalib, meminta keyakinannya dengan Pengadilan Negeri Jakarta Pusat, mengklaim bukti baru. Pada tahun 2008 Pengadilan Negeri Jakarta Selatan membebaskan jenderal purnawirawan Muchdi Purwoprandjono atas tuduhan berencana Munir, AOS pembunuhan. Pada tahun 2009 Mahkamah Agung menguatkan pembebasan dan dikirim kembali kasus tersebut ke pengadilan distrik. Pada bulan September Jaksa Agung, AOS Kantor (Kejagung) menyatakan tidak ada tindakan lebih lanjut dalam kasus terhadap Muchdi Purwopranjono itu dibenarkan, meskipun klaim dari organisasi masyarakat sipil bahwa bukti baru terhadap Muchdi layak review pembebasan nya

Amerika Serikat menyambut baik Menteri Marty Natalegawa dan delegasi Indonesia untuk Kelompok Kerja UPR.
Kami memuji Indonesia untuk transformasi yang luar biasa dari pemerintah otoriter menjadi demokrasi penuh.
Kami memuji kuat terus, pekerjaan independen dari bahasa Indonesia Komisi Nasional Hak Asasi Manusia, yang berfungsi sebagai model regional.
Dan, kami memuji Indonesia untuk mengejar pendekatan kesejahteraan di Papua, dan penciptaan Unit Percepatan Pembangunan di Papua dan Papua Barat untuk membantu menerapkan pendekatan ini dan menangani akar keluhan Papua.
Kami khawatir, bagaimanapun, dengan kegagalan pemerintah untuk membuat, menerbitkan dan menegakkan kerangka kerja pemerintah macam pertanggungjawaban atas pelanggaran oleh militer dan polisi. Selain itu, personel militer bertanggung jawab atas pelanggaran terakhir di Papua dan Papua Barat dihukum karena kejahatan ringan tidak sepadan dengan pelanggaran serius yang mereka lakukan, hasil yang sering karena Indonesia tidak mengkriminalisasi penyiksaan.
Kami tetap khawatir tentang kegagalan pemerintah untuk melindungi minoritas agama tertentu, khususnya komunitas Ahmadiyah dan Kristen.
Kami tetap prihatin tentang tuduhan pelanggaran hak asasi manusia di Papua dan Papua Barat dan keterbatasan pemerintah pada akses ke daerah-daerah oleh para wartawan dan organisasi masyarakat sipil.
Mengingat masalah ini, Amerika Serikat membuat bahwa rekomendasi berikut:
Secara khusus mengkriminalisasi penyiksaan dalam KUHP Anda dan memastikan bahwa para pejabat keamanan harus bertanggung jawab atas penyiksaan dan pelanggaran HAM;    
 

Akhir penuntutan di bawah Pasal 106 dan 110 KUHP Anda untuk berolahraga secara internasional dilindungi hak kebebasan berekspresi, dan mengevaluasi kembali keyakinan dan kalimat individu dituntut karena tindakan tersebut, dan

embaga pelatihan dan kampanye kesadaran bagi para pejabat provinsi dan kota di menghormati aturan hukum berkaitan dengan melindungi kebebasan beragama dan hak-hak lainnya dari anggota agama minoritas.
