RI panggang atas Catatan hak Asasi Manusia Pada Sesi HAM PBB

Written By Voice Of Baptist Papua on July 11, 2013 | 10:28 PM

Laporan Yohanna Ririhena, The Jakarta Post - Jenewa

Komite wakil ketua Yadh Ben Achour mencatat budaya endemik impunitas meski negara meratifikasi ICCPR.

Tokoh Gereja. Socratez S. Yoman

JAYAPURA— Dua  Tokoh Gereja vokal di Papua masing-masing,  Pdt. Socratez Sofyan Yoman dan Pdt. Dr. Beny Giay,  bertemu Dubes Belanda Tjeerd de Zwaan  didampingi Wakil Kepala  Divisi  Politik Kedubes  Belanda, Maarten Van Den Bosch.

Why is West Papua closed to foreign journalists?

Written By Voice Of Baptist Papua on May 15, 2013 | 6:28 PM

Opinion By. Socratez Sofyan Yoman - In TAPOL.ORG

Socratez Sofyan Yoman
Earlier this year I had a meeting with a friend who is a foreign journalist in Jakarta. During our conversation which lasted almost an hour, I asked him. ‘When are you planning to visit Papua to get information directly from there?’ My friend said: ‘We are not permitted by the Indonesian government to visit Papua. I have made several requests to visit Papua but the government has turned down all my requests.’ So I asked him: ‘Why are they not allowing you to visit Papua’ to which he replied: ‘The Indonesian government always says that it is not possible to guarantee the safety of foreign journalists in Papua. The OPM could kidnap or kill them.’

On hearing this, I burst out laughing which surprised my friend who asked me why I was laughing. I said because what government says is very strange; there is no justification for them to say such a thing.

This was not the first time I had heard this from journalists. Every foreign journalist has told me the same thing. My response has always been: ‘Isn’t it because they have something to hide. What is the Indonesian government doing to the Papuan people?’

If foreign journalists are not allowed to visit Papua, it must surely mean that the government has something to hide. If the Indonesian government has been helping the Papuan people to make progress in the past fifty years, then surely foreign journalists would be allowed to go there so as to be able to report on progress there with regard to education, health, the economy, culture and all aspects of life and make this information available to the international community.

One thing is certain. Papuans are not kidnappers, they are not murderers. Papuans want peace and have always respected other human beings throughout the ages. Long before the Indonesian government occupied and colonised Papua as a result of the New York Agreement on 15 August 1962, when administration of the territory was handed over by the United Nations to Indonesia on 1 May 1963 and the fraudulent Act of Free Choice took place in 1969. Ever since 5 February 1855, foreigners, white people from Europe have been coming to Papua as missionaries or evangelists. I would also mention Gotlob Geisler and Carl William Ottow and other foreigners who have visited Papua since 1855, that is to say 107 years before the Indonesian government annexed Papua in 1962. These foreigners stayed there with the indigenous Papuan people.

Johann Gotlob and Carl William Ottow arrived in Papua on Sunday, 5 February 1855. They landed in the Gulf of Doreh Mansiman, Manokwari. The moment they set foot here, they declared: ‘In the name of our lord, Jesus Christ, we set foot in this land!’ These two men brought us the Bible of Jesus Christ.

5 February 1855 is an historic day, a day full of holiness, bringing good news. It was the Bible, the holy word, which freed people from their sins and freed them from oppression and colonialism. The Bible respects the basic rights of mankind, recognises the dignity of the person. No more crying, no more bloodshed, an end to discrimination and exploitation of ordinary men and women because they have been freed from repression. The Bible of Jesus Christ is the holy book which belongs to all humanity, to the people of all ethnicities, to all nations.

When the two German missionaries arrived in the Land of Papua, they met the people, befriended them, stayed there, respected the people and recognised their right to life, their dignity and treated the people of Papua as equals. They never did anything to harm the Papuan people, either physically or mentally. Gotlob and Geissler were true, loyal friends of the Papuan people, in good times and bad times. There were no differences, no barriers. They brought love, justice and equality which flowed from the Cross which they brought.

The Indonesian government’s decision to refuse to allow foreign journalists to visit Papua is in sharp contrast with the mission of the Church and the heartfelt beliefs of the Papuan people. This refusal is an integral part of the government’s policy. It is a reflection of ‘Generative Politics’ about which Mr Nugroho wrote in The Jakarta Post on 10 June 2012. According to Mr Nugroho, Generative Politics is a political stance which has paralyzed, damaged and made the conditions of the Papuan people much worse. This has been the political approach of the Indonesian government for the last fifty years. The Indonesian government has refused to allow foreign journalists to visit Papua because they have to hide these ghastly facts, the widespread poverty in Papua and the many years of brutality to which the Papuan people have been subjected.

A lengthy struggle will be needed to change government policy which has been implemented for the last five decades. Almost 330 years ago, in 1780, William Wilberforce, a member of the English parliament, waged a 20-year struggle to end slavery. As an old man, he said: ‘I realise that changing public opinion is not as easy as clapping your hands; it takes decades to achieve things. You also need patience and total commitment to achieve lasting justice, reform and final victory.

In his struggle for justice, Wilberforce also expressed the following beautiful ideas: (1) Christianity is the key to justice and well-being for a people. (2) The only people who can be trusted to struggle for peace and the nation’s well-being are those who have expressed remorse for their sins. (3) The only hope for a nation is its Christianity. I will accept no ideology that conflicts with the teachings of Christ. (4) If a nation only thinks about physical and cerebral things, they will lose their spirituality. (5) Every tyrannical action that is perpetrated in order to reinforce stability can only lead to the perpetuation of repression. (6) The commandments I have received from God have convinced me that the search for justice must be based on fear of the Almighty which does lead to anarchy and that history has shown that He is right. (7) I should at all times remember that it is my responsibility until my dying day not just to meditate but also to act. (8) The thing that has inspired me is an understanding of the existence of humanity. This is based on the opening words in the Book of Genesis which states that mankind was created in the image of the Almighty [Genesis 1:26-28].

It may very well be that the government’s decision to refuse to allow foreign journalists to visit Papua is because of recent incidents such as the hostage-taking incident in Mapenduma in 1996, the taking of a Belgian as a hostage in June 2001 and his release in August of that year, or the occasion when shots were fired at a German, Pieper Dietmar Helmut at Base G Coast on 29 May 2012 which was alleged to have been committed by an ‘an unidentified person’ (OTK). And there are a number of questions that need to be asked about the acts of violence and crimes against humanity which have occurred during the 50 years of Indonesia’s occupation of Papua.  (1) Were these actions perpetrated by a Papuan? (2) And if so, who masterminded these incidents? And who benefitted from these acts of violence?

During a conversation I had in August 2013 with General Maruf, Deputy Head of BIN, the State Intelligence Agency, I said: ‘Mr Maruf, there are many groups in Papua which have been organised by the OPM. Does anyone believe that there are sewing-machines in Papua to make Morning Star Flags? Is there a shop in the forest where it is possible to buy cloth to make Morning Star Flags? How is it possible for the OPM to get hold of so many weapons and so much ammunition? Every airport and entry point into Papua, by land, air or sea, is tightly guarded and every single thing that enters Papua is carefully examined by Indonesian security officials.’ In response, Mr Maruf said: ‘Only now do I realise there are groups in Papua which have been organised by the OPM.’

It should now be crystal clear to the reader that the kidnappings and shootings that have occurred in Papua were not committed by the genuine OPM but by a specially controlled OPM. Some readers may have read my book: Annihilation of Ethic Melanesians: Breaking the Silence about the History of Violence in West Papua (Permusnahan Etnis Melanesia: Memecah Kebisuan Sejarah Kekerasan di Papua Barat) 2007, which has been banned by the Indonesian government, by virtue of a decision of the Attorney-General. On pages 225-256, I wrote briefly about the genuine OPM and an OPM which was created by the Indonesia military and police. The violence and crimes against humanity have been used to stigmatise Papuans as separatists and are alleged to be acts of treason perpetrated by the OPM in order to create a myth portraying Papua as a region of conflict and is inaccessible to foreigners. Papua is being used as a training ground for the armed forces to get promoted, to make lots of money, a place where more and more troops are sent to combat separatism. Ottow and Geissler never did anything to stigmatise Papuans as separatists, treacherous rebels, as OPM, primitive, ignorant, backward people, cannibals, stupid and under-developed.

An intelligence expert, AC Manulang, former Director of BAKIN. Badan Inteligen Negara Indonesia, the Indonesian State Intelligence Agency, recently acknowledged ‘It is not unlikely and may often have happened that disruptive activities in various places have been masterminded from Jakarta. It is highly likely that these disturbances have been designed in Jakarta for a number of reasons. It is not logical to believe that local police chiefs would not seek the help of influential local leaders to prevent local communities from becoming uncontrollable. Action has been taken to deal with SARA [an Indonesian acronym for Social, Religious and Ethnic Disputes], in places like Maluku or other regions in eastern Indonesia. There have also been disturbances in western parts of the country. According to information I have received, there have been disturbances in Ambon, Lampung, Poso as well as in Papua. These disturbances should be regarded as serving the interest of the elite in Jakarta.’ [Indopos, Sunday 4 November 2012.]

There are other questions that need to be raised: (1) Why is it that the OPM has never kidnapped foreign missionaries who have been living for years in the interior of Papua, in places that are remote from the cities? (2) Why has the OPM never kidnapped any of the many foreign tourists who visit Papua on their own or in groups? (3) Why is it that the OPM has never kidnapped transmigrants who now live in places close to the forests and far from  the  cities, in places like Sorong, Manokwari, Nabire, Merauke or Keerom-Arso?

It is deeply distressing that State violence continues to occur in our sacred Motherland. This means that the Indonesian government and the security forces have failed to turn the indigenous Papuan people into Indonesians. Papuans have already expressed their dismay about all this on a number of occasions: (a) the Eleven Recommendations of the Papuan People’s Assembly on 9-10 June 2010. (b) The Joint Statement of Church Leaders issued on 10 January 2011. (c) The Theological Declaration of Church Leaders on 26 January 2011. (d) The Prophetic Message of Papuan Church Leaders to the President of the Republic of Indonesia adopted in Cikeas, Jakarta on 16 December 2011.

The same concerns were acknowledged by a number of member states of the United Nations: The USA, United Kingdom, Switzerland, Canada, Norway, South Korea, Japan, France, Germany, Mexico, New Zealand, Australia, Spain and Italy at a session of the UN Human Rights Council (UPR) on 23 May 2012 in Geneva, Switzerland.

Bearing these facts in mind, it is the now widely believed that the Indonesian government and the Indonesian security forces are themselves part of all this violence and that this situation has been created and kept alive so as to legitimise continued acts of violence in the Land of Papua and to utilise these conditions as an excuse to reinforce the security forces. The reason why foreign journalists are refused access to Papua is clear for all to see. It means that they can know nothing about and cannot expose the terrible truth regarding the State violence being committed against humanity, the impoverishment and annihilation of the Papuan people that has been going on for the last fifty years.

INDONESIA: Ongoing violence in Papua and the need for dialogue

This is a joint statement by the Asian Human Rights Commission (AHRC), the Commission of the Churches on International Affairs / World Council of Churches (CCIA/WCC), Dominicans for Justice and Peace (Order of Preachers), Franciscans International (FI), the International Coalition for Papua (ICP), Survival International (SI), United Evangelical Mission (UEM), Vivat International (VI), and the West Papua Netzwerk (WPN).

A wave of persecution against political activists under the cover of anti-terrorism measures since summer last year has resulted in arbitrary arrests and fabrication of charges with the aim to silence political activists and human rights defenders in the Papuan provinces of Indonesia.

On January 21st, 20 inmates of the notorious Abepura prison, in which many of Papuan currently 33 political prisoners are located, were tortured and ill-treated. The prisoners were beaten with electro wires. We welcome the removal of the prison head following interventions from rights groups. However, to end the ongoing climate of impunity in Papua, criminal proceedings need to be started against these and all other perpetrators of torture, ill-treatment, intimidation and other human rights violations.

In another case on February 15th, 7 Papuans were stopped and arrested in Depapre, Papua and later brought to the Jayapura Police station. The victims were tortured while being interrogated about contacts to political and human rights activists who already had to go into hiding for several months. While 5 of the victims were released on the following day, Daniel Gobay and Matan Klembiab were falsely charged with illegal possession of sharp weapons under the emergency regulation 12/1951 as reported by the Asian Human Rights Commission

Concerned WPAT, RI Limiting UN Special Rapporteur Visit Papua and Ambon Prisoner

West Papua Advocacy Team
c/o PO Box 21873

wpat@igc.org
+1- 575-648-2078

The Honorable Hillary Rodham Clinton
Department of State
Washington, DC 20520
via fax

Dear Secretary Clinton:

The West Papua Advocacy Team respectfully requests that you raise the following concerns in your upcoming meetings with Indonesian officials during your visit to Jakarta:

The Killing of Mako Tabuni
On June 14 in West Papua, Government of Indonesia security elements shot and killed Mako Tabuni, a prominent Papuan human rights advocate. According to eyewitnesses, Mr. Tabuni was shot by plainclothes officers after he eluded their attempts to force him into an unmarked vehicle. Although he was badly wounded, the plainclothes officers failed to take him to a nearby hospital and instead brought him to a distant police facility where he died. The appearance and modus operandi of the security officials strongly suggest that they were members of the U.S.-funded "Detachment 88." This unit has been accused of human rights violations in West Papua and elsewhere by reputable human rights organizations.

The issue of impunity continues to prevail in Indonesia and Timor-Leste because the authorities of the two governments only want to improve diplomatic relationships and have neglected the human rights violations that occurred during the Indonesian occupation.

We strongly urge you to insist that the Government of Indonesia conduct a thorough and transparent investigation of the killing of Mako Tabuni.

Military Operations Impacting Civilians
For decades the Government of Indonesia has conducted military operations in remote areas of West Papua purportedly aimed at countering the activity of the small, lightly-armed Papua Freedom Movement (OPM). These operations have severely affected local civilians resulting in the destruction of homes, places of worship and public buildings, and causing the flight of civilians to nearby forests where they face life threatening conditions. Invariably, security forces impede efforts by humanitarian relief organizations to assist these displaced civilians. Many civilians have died as a result of these military operations. Currently such an operation is underway in the Paniai region.

We strongly urge you to call on the Government of Indonesia to cease resort to armed measures to address largely peaceful Papuan protests and to permit humanitarian relief organizations to respond to the urgent human need generated by these military operations.

Provision of Vital Human Services to Papuans
Since assuming control of West Papua through the widely discredited "Act of Free Choice" over 40 decades ago, the Government of Indonesia has consistently failed to provide minimally adequate health, education and other vital services to the Papuan people. That failure has resulted in health and education indices for the Papuan population that are consistently among the lowest in Indonesia and the region and have prompted charges that Jakarta's malign neglect of the Papuan people's basic human needs amounts to genocide.

We strongly urge that you press the Government of Indonesia to address the dearth of human services in West Papua and that the U.S. Government increase its own assistance, particularly in the areas of health, education and creation of employment opportunities for the systematically-marginalized Papuans.

Papuan Political Prisoners
Human rights organizations such as Amnesty International and Human Rights Watch have repeatedly accused the Government of Indonesia of incarcerating Papuans for peaceful activities protected under international covenants assuring the right to peaceful political activity and the right to assembly. Moreover, these organizations and a 2007 report by a UN Special Rapporteur determined that conditions of incarceration for these (and other) prisoners and detainees do not meet minimal international standards. Recently, Papuan political prisoner (and Amnesty International Prisoner of Conscience) Filep Karma has suffered delays in the provision of crucial medical services guaranteed him under international covenants to which Indonesia is a signatory party.

We strongly urge you to raise with Indonesian officials concern over the continued persecution of peaceful dissent by Papuans and their mistreatment when in custody, including the Indonesian government's failure to provide minimally adequate medical care as required under international law.

U.S. Sale of Attack Helicopters to Indonesia
In March of this year, 90 international NGO's urged the U.S. not to sell AH-64 Apache attack helicopters to Indonesia. These organizations argued that provision of these helicopters would pose a direct threat to Papuan civilians, who have suffered deadly TNI (Indonesian military) assaults for many years. Specifically, the NGO's noted that the heavily-armed AH-64 was a highly lethal weapon which could be used to escalate conflict within Indonesia and in West Papua as these aircraft would substantially augment the TNI's capacity to prosecute its "sweep operations" in West Papua. The consequence of this augmentation of the TNI arsenal would lead to increased suffering among the civilian populations long victimized by such operations.

We again urge that the U.S. government not approve the sale of this weapon system to the Indonesian military and that you use the occasion of your visit to inform the Indonesians that the sale will not go forward.

Calls for Government of Indonesia-Papuan Dialogue
Respected Papuan leaders have long called on the Government of Indonesia to engage in an internationally mediated dialogue with the Papuan people regarding the future of West Papua. At the July 2011 "Papua Peace Conference" which convened in Jayapura with more than 1,000 in attendance, Papuan representatives were selected for such a dialogue. The Indonesian Government observed this conference at the ministerial level.

Welcoming past U.S. Government support for a dialogue, we urge you to reiterate U.S. Government encouragement for such a dialogue.

Thank you for your consideration of our concerns.

Respectfully,

  The West Papua Advocacy Team

In the 1960s, West Papuans were sacrificed in the name of Cold War politics – and the UN did nothing about it.

Thousands have taken part in rallies across West Papua and in Australia to mark the UN Secretary-General’s (UNSG) visit to Indonesia, calling on Ban Ki-moon to revisit UN mistakes that lead to the denial of West Papuans’ right to self-determination and to assist in resolving ongoing human rights abuses in Papua.

UN peacekeeping was at the top of the agenda of the UNSG’s visit to Indonesia on Tuesday. West Papua was not, but many argue that it should be. After all, West Papuans are asking that the UN revisit its first - and flawed – administration of a post-conflict society. Observers hailed the success of the UN administration of East Timor and its successful transition to independence.

But few are aware of the UN’s failure in its first attempt at administration in West Papua more than 40 years earlier. East Timor got a democratic vote. West Papua got a sham vote. East Timor got independence. West Papua became part of Indonesia – against its will and in breach of its right to self-determination under the UN Charter.

Had the UN properly discharged its mandate back then, West Papuans would have celebrated more than 40 years of independence instead of having endured nearly 50 years of oppression. In that time, it is estimated that as many as 500,000 Papuans have been killed at the hands of Indonesian security forces. Yale and Sydney Universities report that the situation is approaching genocide. Papuan activists campaigning for self-determination are routinely arrested and jailed for peacefully expressing their political opinions.

The recent conviction of the Jayapura Five – including Forkorus Yaboisembut, a Papuan tribal leader – drew international condemnation from lawyers and human rights groups. Speaking from prison, Yaboisembut – a recognised political prisoner – called upon Ban Ki-moon to organise peace talks with Indonesia and to use his visit to Jakarta’s new Peacekeeping Centre to negotiate the release of all political prisoners in Indonesia.

The UNSG made no public supportive comments about West Papua during his visit.
But he may have been dissuaded from doing so given the controversy caused by his comments at the Pacific Islands Forum last September.

Controversy over West Papua

At the Forum, Ban was pressed to support peaceful dialogue between West Papua and Indonesia, to put an end to human rights violations, and “to find a strategy to get Indonesia out of a land that isn’t theirs”. In response to media questions, Ban said that West Papua should be discussed at the Decolonisation Committee of the UN General Assembly. He emphasised that the UN would “do all to ensure” that human rights will be respected in West Papua and that “whether you are an independent state or a non-self-governing territory or whatever, the human right is inalienable and a fundamental principle of the United Nations”.

Ban’s comments implicitly recognise that there is a legitimate case for review of West Papua’s legal status, as well as an acknowledgment that there is basis for concern regarding the human rights situation. West Papuans welcomed Ban’s comments in the belief that, after a long history of UN betrayal, the UN may finally act in their interests and protect their rights under the UN Charter.

The UN act in accordance with the UN Charter? Seems a pretty reasonable expectation. But, sadly, Ban’s comments were highly controversial – representing “a remarkable shift” by the UN chief on West Papua since Ban was “the first head of the UN to come out and say that”. Fifteen human rights and social justice movements immediately called on Ban to appoint a special UN representative to investigate alleged human rights violations in West Papua and its political status.

But the shift in position was apparently too radical to countenance. Days later, and no doubt in response to Indonesian complaints, an unnamed “Official Spokesperson for the Secretary-General” announced in New York that his “off-the-cuff response may have led to the misunderstanding that he was suggesting the matter of Papua should be placed on the agenda of the Decolonisation Committee. The Secretary-General wishes to clarify that this was not his intention.” While the correction let stand the UNSG’s apparent endorsement of the need for the UN to “do all to ensure” human rights are protected in West Papua, no action has yet been taken.

It appears the UN has let West Papua down – and this is not the first time.

The UN’s history in West Papua

West Papua is the western half of the island of New Guinea, just 300 km north of Australia. The other, better-known half of the island is the independent state of Papua New Guinea (PNG). The Melanesian peoples of West Papua and PNG share similar ethnicities, cultures and religions. It is merely their different colonial past that sets them apart.

West Papua (then West New Guinea) was colonised by the Dutch, but for convenience’s sake was loosely administered as part of the Dutch East Indies – modern-day Indonesia. When Indonesia obtained independence after World War II, West New Guinea remained under Dutch control and was prepared for independence, as was PNG by Australia. West Papua was a Dutch colony and Non-Self Governing Territory on the path to independence. More than 50 years ago, on December 1, 1961, West Papuans raised their flag and sang their national anthem as they formally announced their independence from the Dutch.

Soon after, Indonesia invaded with political support and arms from the USSR. The US – concerned about losing Indonesia to the Russians and keen to secure lucrative mining contracts – intervened. Under US pressure, the Dutch agreed to a UN- and US-brokered settlement, the New York Agreement of 1962, providing for a UN-supervised Indonesian administration and vote for self-determination by which Papuans could choose independence or integration with Indonesia.

West Papuans were not consulted.
Under the terms of the agreement, West Papua was transferred by the Netherlands to a United Nations Temporary Executive Authority (UNTEA). Between 1962 and 1963, UNTEA had full authority to administer the territory, to maintain law and order, and to protect the rights of the West Papuans. The territory was then transferred to Indonesian administration in 1963, but on condition that it remained under UN supervision until the vote for self-determination in 1969.

Media reports from around the world at that time highlighted the need for UN vigilance in ensuring a free and fair vote. In 1962, one editorial emphasised, “there is no doubt at all about the United Nations’ responsibility under the agreement – quite apart from its moral responsibility – to ensure the Papuans are allowed to exercise a free choice” and that responsibility “should need no stressing”.

But the UN turned a blind eye – both to human rights abuse and the fact the voting practices did not meet international standards. The 1969 “Act of ‘Free’ Choice” is popularly known as the “Act of ‘NO’ Choice”. A handpicked group of 1,022 West Papuans were coerced, under threat of violence, into voting unanimously for integration with Indonesia.

During the period of UN supervision and in the lead-up to the vote, the Indonesian military is estimated to have been responsible for the deaths of 30,000 West Papuans. Frank Galbraith, US Ambassador to Indonesia at the time, warned that Indonesian military operations “had stimulated fears… of intended genocide”. Australian journalist and eye-witness Hugh Lunn reported that Papuans carrying signs saying “one man, one vote” in protest against the voting procedures were arrested and jailed. Others were killed.

The UN was aware of the repression – but did nothing about it. And, worse, it collaborated with Indonesia to prevent international criticism.

Meantime, the US and Indonesia were busy carving up West Papua’s rich natural resources. Having signed concession agreements with US mining company Freeport in 1967, two years before the scheduled vote, Indonesia had no intention of allowing West Papuan independence (Freeport is a major contributor to Indonesia’s GDP, and Kissinger was later rewarded with a place on Freeport’s board).

The US agreed, but diplomatic cables reveal that it was worried that UN members might “hold out for free and direct elections” (as required by international law), frustrating Indonesia’s intentions. The US discussed the need to meet with the UN Representative, Ortiz Sanz, to “make him aware of political realities” but later reported, with relief, that Ortiz conceded “that it would be inconceivable from the point of view of the interest of the UN, as well as the [Indonesian government], that a result other than the continuance of West Irian within [Indonesia]“. In July 1969, a US diplomatic cable reported that the “Act of Free Choice… is unfolding like a Greek tragedy, the conclusion preordained”.

West Papuans were sacrificed in the name of Cold War politics and natural resources.
UN officials admitted in private that 95 per cent of Papuans supported independence. But as UN Representative Ortiz Sanz told Australian journalist Hugh Lunn, “West [Papua] is like a cancerous growth on the side of the UN and my job is to surgically remove it”. And remove it he did. In 1969, Sanz reported the vote’s outcome to the UN General Assembly, noting only that “Indonesian” and not “international” voting practice was adopted. West Papua formally became a province of Indonesia.

Former UN Under-Secretary General Narasimhan has since admitted the process was a “whitewash”. British diplomatic correspondence admitted “the process of consultation did not allow a genuinely free choice to be made”. Distinguished international jurists dismiss the 1969 vote as a “spurious exercise”, amounting to a substantive betrayal of the principle of self-determination.

Yet no action has been taken by the UN – or the international community – to redress this injustice. A growing number of international parliamentarians are calling upon their governments, through the UN, to give effect to West Papua’s right to self-determination. As Archbishop Desmond Tutu, a supporter of West Papua’s campaign to have the UNSG instigate a review, has asserted, “[a] strong United Nations will be capable of, among other things, acknowledging and correcting its mistakes”.

Rights groups have urged the UNSG to appoint a Special Representative to investigate the situation in West Papua, including the outcome of the 1969 “Act of Free Choice” and the contemporary situation, and ask that he use his good offices to negotiate the release of political prisoners and persuade the Indonesian government to lift the ban on access to West Papua for international organisations and journalists.

But will Ban Ki-moon act?

No UN action forthcoming – yet

Since his comments last September, the UNSG has remained silent on West Papua. At his talk in Indonesia on March 20, Ban recalled his own experience as a young boy in South Korea – where he said that UN peacekeepers had been “the beacon of hope” for his people.

Like Ban, the people of West Papua once saw UN peacekeepers as their hope. But as Dr John Saltford, author of The United Nations and the Indonesian Takeover of West Papua, 1962-1969: The Anatomy of Betrayal, has said: “The Papuans had a great deal of trust in the UN, and the UN betrayed them and continues to betray them because, so far, it has refused to review its position on the issue.”

As the Human Rights Council is preparing for Indonesia’s Universal Periodic Review, submissions have poured in with evidence of widespread human rights abuse in West Papua – evidence that many hope will spur the UN into action. But given its history on West Papua, should Papuans place further hope in the UN?

The UNSG’s remarks in Indonesia this week also urged hope in the UN, drawing on his own experience in South Korea: “Please have a bigger sense of hope, don’t despair! It may be very difficult for you. But look at me. As a young boy, I was very poor. [South Korea was] almost on the verge of collapse… But because there was the United Nations, because there is still the United Nations, you can have hope… This is my message to you.”

Let’s hope he is not encouraging more false hope from West Papuans in the UN. Let’s hope the UN will act – because if it does not, then it is simply not the organisation that its leader believes in.

PBB Segera Fasilitasi Referendum di Papua

Written By Voice Of Baptist Papua on July 4, 2012 | 9:09 PM

Namun ia menolak menyatakan dirinya menganut ideologi Papua merdeka. "Saya hanya penyambung lidah umat."

Boleh jadi, pernyataan Socrates itu benar. Seorang sumber merdeka.com paham situasi di Papua menegaskan, "Kalau referendum digelar sekarang, 99 persen Papua merdeka."

Dialog Damai Jakarta-Papua: “Tanpa Syarat dan Melibatkan Pihak Ketiga Yang Netral

Opini Oleh Socratez Sofyan Yoman

(Summarey of Jack W. Lydman’s Report, July 18, 1969, in NAA, Extracts Given to Author by Anthony Bamain). (UNGA Official Records MM, Ex 1, Paragraph 126).
Annex I, A/7723,paragraph, 243, p.47).

Inf.

Sedangkan Mahfudz Siddiq, Ketua Komisi I DPR RI mengungkapkan: “ Masalah Papua sudahmultimensi.
( Prioritas: Nasip Papua di NKRI, Edisi 24-Tahun I, 25 Juni-1 Juli 2012, hal. 8). Sementara Tubagus Hasanudin, Wakil Ketua Komisi I DPR RI, “melihat akar persoalan Papua perbedaan persepsi soal Penentuan Pendapat Rakyat (PEPERA) 1969, marjinalisasi masyarakat Papua, trauma operasi militer dan gagalnya Otonomi Khusus” (Kompas, Jumat, 29 Juni 2012, hal. 5).

Sedangkan SekretarisJenderal Dewan Ketahanan Nasional Letnan Jenderal (TNI) Junianto Haroen mengatakan: “persoalan Papua harus diselesaikan dengan cara-cara tanpa kekerasan” (Kompas, Jumat, 29 Juni 2012, hal. 5).
