The State Visit to the UK of Indonesian President Susilo Bambang Yudhoyono has been beset by protests against his government’s human rights abuses in West Papua, Aceh and the Moluccas.

On Wednesday police arrested human rights campaigner Peter Tatchell when he unfurled a West Papuan flag as the Indonesian President’s limousine departed Westminster Abbey in central London.

"I went to where the President's motorcade was passing and tried to hold up a West Papuan flag. Unidentified men in plainclothes wrestled me to the ground. I was then arrested by Metropolitan Police officers, who claimed they were acting at the request of the President's entourage. The officers applied unnecessary, excessive force, given that I was no threat and was not resisting arrest," said Mr Tatchell, who is Director of London-based the human rights organisation, the Peter Tatchell Foundation.

He was one of nearly 100 protesters who had gathered to protest at human rights abuses by the Indonesian regime.

"Under Indonesian rule, West Papuans are denied basic human rights, including freedom of expression. Two Papuan men, Yusak Pakage and Filep Karma, have been jailed for 10 and 15 years respectively for merely raising the West Papuan flag. Foreign media and human rights groups are denied access to the region by the Indonesian Government.

"The Indonesians annexed West Papua in the 1960s. The West Papuan people never agreed to be a part of Indonesia. Jakarta maintains its rule by military force. It refuses to allow the people of West Papua the right to self-determination, in flagrant defiance of the United Nations Charter.

"A long, slow genocide is being perpetrated in West Papua.

"I was arrested for a peaceful, lawful protest, which involved nothing more sinister than holding a flag. I was deemed to have breached the peace. I was also threatened with further breach of the peace charges for "shouting loudly" and for what one police officer described as "pointing your finger at me in a way that I find intimidating."

"A police officer intimidated by a pointed finger? Bizarre. Are police officers nowadays really such ultra-sensitive souls? Heavens help us if they have to deal with hardened criminals with weapons.

"I was put in rigid handcuffs that were twisted by the police, which pinched the nerves in my wrist; causing agonising pain. It seemed like this was deliberate. I am still in pain hours later but what was done to me is nothing by comparison to the daily brutalities inflicted on the heroic people of West Papua by the Indonesian army of occupation.

"I am saddened that some police officers apparently have no respect for freedom of expression and the right to peaceful protest.

"I was detained unlawfully and deprived of my liberty for two hours. After being taken to Charring Cross police station, I was eventually released without charge. Clearly, the police knew they had over-stepped the mark and that the charges against me were baseless," he said.

The Asian Human Rights Commission (AHRC) yesterday called on the government to launch a criminal investigation into the shooting and arrest of an unarmed man last month by police in Papua province.
Kristian Belau, 21, was shot in the leg and arrested in an altercation with police following a night out with friends in Nabire district on September 24.

According to Yones Douw, a local rights activist, Belau and several other young men had stopped a police car while drunk and demanded money from the officers inside.
“The police fired three warning shots, which scared the young men off,” Douw said.

Police then launched a search for the young men and found Belau and two others.
“Two of them escaped. Belau, however, was very drunk and approached the police instead of running away. As he did so, they shot him even though he was unarmed and didn’t pose any threat,” Douw said.
The AHRC agrees with Douw and says the police exercised “excessive use of force.”

“Under Indonesian law, police should only use force in situations where it is strictly necessary. The force used should also meet the ‘proportionality test’ – it should not be greater than the danger caused by the threat,” the commission said.

The AHRC demanded the shooting be adequately and effectively investigated. It has also questioned the police version of events which stated that Belau was shot during a gunfight.
“That’s not true. There was no gunfight. The police are telling lies,” said Marthen Goo, head of the National Papuan Solidarity.
“We have lost our trust in law enforcement officials, including the police. How can we report criminal activities to police when, in fact, they are the perpetrators?” he said.

Indonesia, No mass killings can ever be justified

The Asian Human Rights Commission (AHRC) is disturbed with the recent rejection of the Indonesian government to the findings by the National Human Rights Commission (Komnas HAM) claiming the 1965 massacre constituted a gross human rights violation. 

As reported by national media, the Coordinator Political, Legal and Security Affairs Minister Djoko Suyanto insisted that the mass killing was justified as it was aimed at saving the country from communism. The Minister further claimed that Indonesia "would not be what it is today if it did not happen".

Previously in July this year, Komnas HAM concluded its four year investigation on the 1965 massacre. It found that gross human rights violations had been perpetrated by the state during 1965-1966 against individuals allegedly to be communists. Komnas HAM noted that systematic and widespread killings, torture, enforced disappearances, rape, arbitrary detention as well as other human rights abuses had taken place during the particular period. Despite these findings, Djoko Suyanto suggested President Susilo Bambang Yudhoyono not to make an official apology for the abuses.

The AHRC wishes to emphasise that gross human rights violations such as crimes against humanity cannot be justified in any circumstances. 
Denial on the occurrence of such abuses is hurtful and disrespectful to the victims and their families who in fact should be provided with adequate reparation such as acknowledgement of the facts and acceptance of responsibility and other forms of satisfaction from the state. Under widely accepted international human rights principles, the states have the duty to investigate any allegation on gross violations of human rights as well as to prosecute and punish those who are responsible for it.

The AHRC is also concerned by the Minister’s statement which has reaffirmed the stigmatisation against communism and those who share the ideology. Discrimination towards people who are alleged to be ex-supporter of the Indonesian Communist Party (PKI) is still ongoing to date and an inconsiderate, lack of human rights understanding statement such as one just delivered by the Minister will only preserve, if not aggravate, it. 
As a country who claimed itself to be a supporter of freedom of opinion, Indonesia should treat communism as any other ideology instead of taking it as a threat that those who subscribe to such view can enjoy their rights without any fear of persecution or discrimination.

Given above, the AHRC is calling the Coordinator Political, Legal and Security Affairs Minister Djoko Suyanto to take back his statement and apologise to the 1965 massacre victims for his disrespectful comment. In line with the Indonesian Law No. 26 Year 2000 on the Human Rights Court, the AHRC urges the Attorney General Office to take up the findings concluded by Komnas HAM and to conduct further investigation on the matter at stake. 
With the recommendation of the Parliament, the President shall issue a Presidential Decree ordering the establishment of an ad hoc human rights court to try those who are responsible for the massacre.

(Hong Kong, 19 Juli 2012) Anggota parlemen dari berbagai negara di Asia bangga untuk bertemu dan mendiskusikan cara-cara untuk mengakhiri praktik penyiksaan dan perlakuan tidak layak di negara mereka. Rapat yang berlangsung selama tiga hari ini akan berlangsung di Kowloon, Hong Kong, dimulai pada 21 Juli.
 
Rapat ini merupakan suatu langkah signifikan untuk mengimplementasikan Kovenan PBB tentang Penyiksaan dan Perlakuan atau Hukuman Kejam, Tidak Manusiawi atau Merendahkan Martabat Lainnya (UNCAT).

Anggota parlemen dari Bangladesh, India, Indonesia, Nepal, Pakistan, Phillipines dan Sri Lanka telah memastikan partisipasi mereka dalam rapat ini. Beberapa aktivis hak asasi manusia ternama dari Asia Selatan dan Asia Tenggara juga akan berangkat ke Hong Kong guna berkontribusi dalam diskusi.

Pertemuan ini disponsori oleh Asian Alliance against Torture and Ill-treatment (AAATI). AAATI dibentuk pada Juli 2011, ketika sekelompok aktivis hak asasi manusia dari berbagai negara Asia berkumpul dengan dukungan dari Asian Human Rights Commission (AHRC), Hong Kong, serta Rehabilitation and Research Centre for Torture Victims (RCT), Denmark. Profesor dan mantan Menteri Kehakiman Denmark, Ole Espersen, telah menyampaikan salamnya kepada para peserta konferensi, dengan menyatakan bahwa “hak untuk tidak disiksa sebenarnya bukan merupakan hak yang nyata dan tulus apabila tidak dilengkapi dengan adanya mekanisme penyelesaian bagi korban di mana mereka bisa menggunakan instrumen hukum yang ada untuk mendapatkan reparasi dan pihak yang bersalah dihukum.” Profesor Espersen juga menambahkan bahwa “tanggung jawab utama untuk melawan penyiksaan secara nasional – dan juga pelanggaran hak asasi manusia lainnya, ada pada parlemen dan pemerintah tiap-tiap negara.”

Pertemuan anggota parlemen dari berbagai negara Asia yang akan berkumpul di Hong Kong untuk mendiskusikan kemungkinan cara-cara menghapuskan penyiksaan merupakan suatu acara yang tidak pernah diselenggarakan sebelumnya.

INDONESIA: MIFEE: The stealthy face of conflict in West Papua

West Papua, the easternmost island under Indonesia's control, is a land beset by troubles. Rarely a week goes by without news of some new tragedy in a relentless conflict that has endured and evolved over fifty years.

Last June has been a particularly bloody one: troops have gone on the rampage in Wamena, burning houses and shooting indiscriminately. On the island of Yapen, security forces have been carrying out raids on villages, arresting several people and forcing thousands to flee in fear. Around the West Papuan capital, Jayapura, several supporters of the West Papua National Committee (KNPB) have been killed by police in separate incidents: three men were killed on a demonstration, Teyu Tabuni was shot in the head by a uniformed policeman and finally Mako Tabuni, a KNPB leader, was also shot, unarmed, running from plain-clothes police.

Adding to the climate of tension and fear has been a spate of seemingly random fatal shootings, presumably carried out by someone with a vested interest in promoting conflict. The police say the shootings are the work of persons unknown, who they never seem able to track down. Intelligence agents blame 'separatists'. Papuan groups suspect the state somehow plays a hand.

It is this unstemmed tide of bloodshed and terror that earns remote West Papua any little attention it might attract. And so it must be; a conflict that causes such deep suffering across West Papua must be responded to, whether in Papua, in Indonesia and overseas.
However in Papua there are many other aspects of conflict, more complex and subtle than the headline-grabbing news of shootings and terror.

One factor driving continuing conflict is the lucrative appeal of the natural riches that are to be found in and around West Papua: wood, minerals, fish and land. The military, for example, have a financial stake through their private business such as illegal logging, protection rackets around mining areas, or prostitution or gambling outfits, while using the violent conflict to justify their presence. Meanwhile the lure of possibly finding well-paid work continues to draw many migrants from other parts of Indonesia. This creates tension as native Papuans find themselves stigmatised and marginalised, with no place in the booming economy.

This is the story of how resource conflicts are building in the southernmost part of West Papua, as agribusiness companies stealthily invade the forests, leaving its people dispossessed.

The Claim that West Papua can feed Indonesia and the World. 

West Papua's deep south, the hinterland of the city of Merauke, is less often a flashpoint in the violent conflict than some areas, such as the Central Highlands, the area around the Freeport gold and copper mine in Timika, or the Papuan capital Jayapura. However, a different kind of conflict is occurring in this mostly flat land. Companies are moving in to colonize the land for their plantations, cheating and coercing local people to give up their land.

This conflict goes by the name of MIFEE - the Merauke Integrated Food and Energy Estate. It is an ambitious program designed by the former leader of Merauke Regency Johannes Gluba Gebze together with the national government and certain companies. Together they conceived the idea that the flat and fertile land around Merauke would be the ideal location for a major agricultural expansion, guaranteeing Indonesia's national food security into the future, and establish Indonesia as a food exporter.

The plan was given extra impetus by a Saudi investor, the Bin Laden Group, which promised to invest four million dollars to cultivate rice on 500,000 hectares of land. In the words of the Indonesian President, Merauke would "Feed Indonesia, then feed the world”.

Eventually the Saudis pulled out, and the scheme was redesigned, now allowing for the cultivation of agro-fuel crops as well as food. 50% of the land was designated for rice and other basic food crops, while 20% would be oil palm and 30% sugar cane plantations. A 'grand design' was elaborated for efficient, modern agribusiness, which divided the project area into clusters and provided for associated processing facilities.

MIFEE was officially launched in August 2010. Then as 2011 progressed there was some speculation of whether the program would go ahead or not. For the moment, the ambitious dream it promotes of highly mechanised intensive agricultural production still persists, even if only in glossy reports of Indonesia's national development strategy, the 'Master Plan for the Acceleration and Expansion of Indonesia's Economic Development (MP3EI)', where Merauke is earmarked as a hub of food production.

Seen from the Forest, MIFEE looks a little different

Looking beyond the grand plans, what is actually happening on the ground? Well agricultural development is certainly going ahead, but it's not exactly as had been promoted. There has been limited interest from companies wanting to plant rice or other basic food crops, and those companies that did make such plans complain that there is no-one to foot the bill for the infrastructure development needed.

Instead, companies attracted to the area in 2008, 2009 and 2010 are now starting to develop vast oil palm, sugar cane and wood chip plantations. By May 2010 local government data revealed that there were 36 large plantation plans on the table.

Those plans are indeed vast. If every company in possession of provisional location permits were to exploit their allocations, the new estates would cover more than two million hectares.

Some companies are moving forward faster with their plans, others more cautiously, whilst there has been no news of recent activity from several of the potential investors. However the pioneers are ploughing ahead, and have already started clearing land. Medco, a company whose principal interests lie in oil and gas exploration, has been clearing forest to export wood chips. Another Indonesian company, the Rajawali group, has been planting sugar cane. Korindo, an Indonesian-based Korean company with a history of operating in the area, has been clearing land for oil palm.

Other companies are a few steps behind; applying for the extra permits they need, evaluating the terrain, trying to win the support of local communities and waiting to see how the political and economic climate develops. They include companies owned by some of Indonesia's richest people, including husband and wife team Murdaya Poo and Siti Hartati Murdaya and Martua Sitorus, chief operating officer of Singapore-based Wilmar.

While many of the companies interested in MIFEE are owned by the Indonesian elite, there are also foreign companies planning investment in Merauke, mainly coming from South Korea. Apart from Korindo mentioned above, and the LG International Corporation, which holds a 25% stake in Medco's wood-chip operation, two other Korean companies are involved. One is Daewoo International Corporation (owned by Posco), which is trying to establish itself in West Papua planting oil palm after meeting heavy resistance to its planned land grab in Madagascar, and Moorim Paper, who bought a controlling stake in local company Plasma Nutfah Marind Papua in order to develop an industrial forestry plantation.

When Agribusiness Arrives at Your Village...

The Malind, the indigenous people of Merauke, live in close connection with the forest. Their staple food is the starch of the sago palm which grows in groves in the forest, which they supplement by hunting wild animals. Each person belongs to a clan, which represents an important plant or animal and so connects them to some part of the forest ecosystem. The forest is divided between the different clans for hunting, using a geography based on remembered stories of the ancestors' journeys.
Indonesian law also recognises that local people have collective ownership rights over the forest, which are known as ulayat rights. A company wanting to take control of the land must ensure that it secures the consent of the ulayat holder to be able to use the land.

This becomes the first point of conflict. Big companies, experienced in the art of manipulation and deception, and easily able to buy influence and military protection, flex their muscles against villagers who have always allocated land on a collective basis through age old customary practices.

Armed with GPS machines to delineate exactly the boundaries of their allocation, the companies offer the villagers compensation based on what they regard as the value of the land: the marketable timber contained in the trees that grow on it. By doing this, they claim that they are buying the right to use the land for industrial plantations.

Yet to the Malind, this forest defies valuation: it is not only where they find their sago and hunt animals to nourish themselves, but also their culture, their history and their very identity.

Villagers, local NGOs and local media have reported how companies involved in MIFEE have been cheating local people even out or this limited compensation. In Nakias village, for example, which lies in Korindo's operational area, the company gave villagers the equivalent of $6000 US dollars for the wood they had already taken from their land. This was far below the levels stipulated by the provincial governor, which should include a premium for valuable timber species. But since it was the company who did the accounting of the volumes of wood they had taken, the people had no way to check their calculations.

Villagers from Muting village have also reported that PT Bio Inti Agrindo, a company linked to Daewoo International Corporation, has bought up land for the pitiful price of six dollars per hectare.

Meanwhile in Zanegi village, villagers told researchers from the NGO Pusaka how they were cheated by Medco. In a ceremony in 2009, Medco staff and villagers signed what the company called a “Certificate of Appreciation”, which was accompanied by a gift of $33,400. They took it as a goodwill gesture. Only later, when Medco had felled the forest and wanted to take away the wood did the company's real intentions become clear. They produced a document which they claimed was an appendix to the “Certificate of Appreciation” which stated that wood was to be compensated at 2000 Rupiah per cubic meter, about one-hundredth of what the community would have received if they had sold the wood directly to a local wood-trader.

Other villages in Medco's concession area tell similar stories of deception. They also report broken promises - the schools, clinics, churches and roads which the company was supposed to build and never did.

From around the affected area, the Malind people have regularly voiced opposition to MIFEE and their shock at the people who have already suffered at the hands of Medco, Rajawali and Korindo. Few villagers may want this form of progress, but it is hard to know how to prevent these developments. In May 2012 news came through of communities trying to make it as difficult as possible for the companies. Four villages were refusing to release the land that Korindo wants for less than 100 billion Rupiah, or over $10 million.

It is a large amount of money, but far from unreasonable, as it is the price for the whole population of four villages to accept a permanent dislocation from their current ways of subsistence and somehow join the money economy. Korindo was refusing to offer more than 4 billion Rupiah. But even if they managed to get the full amount that they have demanded, would such a financial prize really reflect the heartfelt aspirations of those villagers?

Sums of money which may be insignificant as a replacement for the forest can nevertheless be large amounts in day-to-day life. This then becomes the cause of further conflict, not directly with the company this time, but between the people themselves. Disputes over land and money have caused envy and conflict between the people of Sanggase and Boepe villages, as it has between Domande and Onggari villages. The arrival of development brings social breakdown in many subtle ways.

Adding to the pressure will be the military and police presence, and the effects of large numbers of migrants from outside Papua who arrive to work on the plantations. The Marind people will be forced to find ways to adapt quickly to new ways of living, or if not, face a life of poverty squeezed between the plantations, the latest victims of the enclosure of land for private economic interests.

This is a slow and stealthy conflict, the transformation of such a great expanse of forest into farmland cannot be done overnight, nor can forest people casually leave behind their identity and livelihood to enter this brave new world. The Malind have a long struggle ahead of them, whether they aim to reject the developments entirely or find some way to adjust to life in very different surroundings.

On the most basic level many Malind people can expect to face hunger, with their sago forests gone and too poor to buy rice. This is the grand irony of MIFEE, a project that was supposed to ensure the food security of the whole of Indonesia cannot even provide a secure future for the people in its immediate area.

INDONESIA: Rekomendasi UPR 2012: Tantangan Komitmen Indonesia dalam Penegakan HAM 4 Tahun ke Depan

KontraS (Komisi untuk Orang Hilang dan Korban Tindak Kekerasan), SETARA Institute, AHRC (Asian Human Rights Commission), ICTJ (International Center for Transitional Justice), PGI (Persekutuan Gereja Indonesia) serta Protection International (PI) menyambut baik rekomendasi hasil sidang UPR (Universal Periodic Review) yang dirilis pada 25 Mei kemarin. Sidang UPR telah meluncurkan segudang rekomendasi penting yang harus ditindaklanjuti oleh pemerintah Indonesia dalam 4 tahun ke depan dalam penegakan HAM.

Tercatat total 74 negara anggota yang berpartisipasi dalam sidang yang digelar 23 Mei 2012 tersebut telah melakukan review terhadap laporan yang disampaikan oleh pemerintah Indonesia. 27 diantaranya anggota Dewan HAM dan 47 lainnya negara-negara peninjau. Tercatat bahwa negara-negara ASEAN telah juga berpartisipasi dalam mereview kondisi HAM di Indonesia.

Terhadap rekomendasi yang diadopsi oleh kelompok kerja UPR pada sesi ke-2 ini, kami melihat sebagai rekomendasi yang cukup komprehensif untuk mengukur komitmen pemerintah Indonesia dalam penegakan HAM yang meliputi banyak isu. Dalam rilis ini kami menghilight beberapa isu yang menjadi konsern dan telah disampaikan dalam laporan versi masyarakat sipil yang telah kami submit sebelum sidang.

Pertama, rekomendasi banyak menggarisbawahi beberapa agenda yang sudah termaktub di dalam Rencana Aksi Nasional (Ranham 2011-2014) diantaranya menyangkut ratifikasi beberapa instrumen internasional yang tersendat. Sebut saja ratifikasi Rome Statue ICC serta OPCAT yang sudah masuk dalam Ranham periode tahun sebelumnya serta masuk dalam rekomendasi UPR pada sesi pertama 2004-2011. Namun, hingga masuk pada review UPR kedua kemarin dua instrument tersebut belum terlihat progress yang signifikan dan bahkan dimasukkan kembali pada Ranham berikutnya 2011-2014. Dalam rekomendasi juga disebutkan adanya pemenuhan ratifikasi Konvensi anti penghilangan Paksa.

Kedua, Rekomendasi atas jaminan penghentian tindakan penyiksaan yang dihubungkan dengan proses amandemen KUHP yang tidak kunjung terselesaikan. Penyiksaan sebagai sebuah kejahatan dalam sidang UPR putaran ke-dua ini banyak disinggung untuk masuk kedalam amandemen KUHP sesuai dengan Konvensi anti penyiksaan yang telah di ratifikasi oleh pemerintah Indonesia. Rekomendasi terhadap amandemen KUHP ini juga muncul sebelumnya pada rekomendasi sidang UPR putaran pertama (2004-2011). Sehubungan dengan penghentian tindakan penyiksaan tersebut, kembali rekomendasi UPR 2012 merekomendasikan adanya pelatihan bagi aparat keamanan serta penegakan hukum dengan membawa para pelaku ke pengadilan sipil dan bukan pengadilan militer (dalam hal pelaku berasal dari kesatuan militer).

Ketiga, keprihatinan pada kondisi kebebasan beragama dan berkeyakinan banyak disampaikan oleh negara-negara dalam sidang UPR 2012 ini. Atas hal itu, rekomendasi yang dikeluarkan khusus menyinggung kebebasan beragama dan berkeyakinan tentang jaminan pelaksanaan kebebasan beragama dan berkeyakinan termasuk mengkhususkan pada kelompok seperti Ahmadiyah, Bahai, Syiah dan Kristen. Dalam rekomendasi ini juga menekankan kepada pemerintah Indonesia untuk mencabut/mengamandemen beberapa perundang-undangan yang ada yang mendiskriminasikan langsung dan tidak langsung terhadap suatu agama atau keyakinan, dimana perundang-undangan tersebut tidak sejalan dengan konstitusi RI dan mekanisme internasional.

Keempat, terkait dengan jaminan perlindungan Pembela HAM, rekomendasi UPR 2012 menekankan kepada pemerintah Indonesia untuk memberikan kepastian atas lingkungan yang aman untuk mendukung kerja-kerja Pembela HAM termasuk juga jaminan untuk melakukan investigasi independen dan tidak parsial atas tindakan kekerasan terhadap pembela HAM dan memastikan adanya proses hukum.

Kelima, spesifik dengan kondisi di Papua, rekomendasi UPR 2012 banyak mengkaitkan dengan isu kebebasan berekspresi khususnya berekspresi dalam isu politik. Penekanan atas jaminan kebebasan berekspresi termasuk diantaranya jaminan kebebasan berpendapat dengan mengakhiri pemberlakukan pasal 106 dan 110 KUHP. Situasi di Papua yang masih jauh dari kemudahan akses para jurnalis, pada rekomendasi kali ini jurnalis baik asing maupun local dipastikan terpenuhi jaminan untuk memperoleh akses dengan bebas untuk masuk ke Papua dan Papua Barat. Pertanggungjawaban atas serangkaian pelanggaran HAM di Papua yang dilakukan oleh militer dan polisi serta iklim impunitas direkomendasikan untuk segera dihentikan.

Keenam, melawan impunitas menjadi rekomendasi yang umum untuk beberapa serangkaian isu yang digarisbawahi dalam rekomendasi UPR 2012. Melawan impunitas dalam hal ini dengan memperkuat undang-undang dan peraturan lainnya termasuk di tingkat pelaksanaannya.
Ketujuh, reformasi di tingkat sector keamanan menjadi bagian rekomendasi yang spesifik disampaikan sebagai upaya meningkatkan penghormatan terhadap HAM dan aturan hukum melalui reformasi pendidikan dan institusi.

Dari serangkaian rekomendasi yang telah disampaikan tersebut diatas, kami menilai bahwa rekomendasi tersebut lebih konkrit dari rekomendasi 4 tahun lalu yang serta merta menjadikan rekomendasi tersebut sabagai tantangan bagi pemerintah Indonesia dalam 4 tahun ke depan dalam penegakan HAM.

Untuk itu kami mendesak kepada pemerintah terkait untuk merealisasikan rekomendasi-rekomendasi tersebut dalam turunan yang lebih konkrit, sehingga perkembangan dari masing-masing rekomendasi tersebut dapat diukur tingkat keberhasilan dalam periode waktu tertentu menuju pada review UPR berikutnya. Konkritnya, kami meminta agar Presiden segera memanggil sejumlah pejabat teras dari institusi-institusi yang terkait dengan isu-isu diatas; seperti Ketua Mahkamah Agung, Kapolri, Jaksaan Agung, Menteri Hukum dan HAM, Ketua Komnas HAM dan lainnya, untuk memastikan bahwa ada upaya yang serius dalam implementasi terkait perlindungan HAM. Tak kurang, kami dari masyarakat sipil pun bersedia untuk menjadi mitra dalam pemenuhan HAM tersebut.

Jenewa - Di pintu rapat sejumlah pria parlente dan wanita berseragam kantor berdiri rapi layaknya antrian. Di depan barisan, berdiri dua polisi berbadan tegap. Mereka  nyaris tidak pernah bicara. Matanya awas memandangi peserta yang masuk pintu pemeriksaan. Di sudut kiri kanan terlihat kamera CCTV. Satu persatu maju sambil meletakkan barang bawaan di mesin pemindai.

"Your glasses please," ujar petugas kepada penulis yang kebetulan lupa meletakkan kaca mata. Layaknya masuk ke area bandar udara, begitu pula memasuki ruangan acara rapat yang membahas tinjauan periodik universal sesi 13 - UPR (Universal Periodic Review), Rabu, (23/5) Jenewa.
Hari itu, ruang XX lantai 2, sekira pukul 9:00-12:30 giliran delegasi Indonesia memberikan laporan periodik HAM selama 4 tahun sebelumnya. Dari meja lingkar terdepan, duduk manis Menteri Luar Negeri Indonesia Marty Natalagewa didampingi stafnya.

Diluar kelaziman jika seorang menteri luar negeri sebuah negara langsung yang membaca dan menjawab tanggapan. Indonesia sudah mengantisipasi mendapat tantangan berat dari NGO dan pemerintah karena rekomendasi-rekomendasi dari UPR 2008 tidak seluruhnya dilaksanakan. Oleh sebab itu, Indonesia mempersiapkan delegasi tingkat tinggi yang terdiri dari 13 orang dan dipimpin langsung oleh Menteri Luar Negerinya.
Di belakang delegasi Indonesia terbentang layar jumbo ukuran bioskop dan perwakilan negara-negara duduk di kursi melingkar menghadap mimbar. Sejurus kemudian, pemimpin rapat H.E Mr Andras Dekany memberikan sambutan. Di akhir ucapannya, dia mempersilahkan Indonesia memberikan laporan, yang diikuti oleh tanggapan-tanggapan dari 74 negara atas laporan Indonesia selama 95 detik per negara.
Dalam mekanisme UPR tidak diatur peranan NGO memberi tanggapan. Walaupun demikian, para NGO kaliber international cukup lihai melobi dan menciptakan mekanisme sendiri untuk menggugat Indonesia, baik melalui lisan atau tulisan.

Seperti diduga sebelumnya, Indonesia melaporkan hal-hal yang positif saja. Dari uraian normatif, Marty menjelaskan terdapat kemajuan penegakan hak asasi terutama masalah kebebasan beragama. Sebagai contoh, dia menuturkan ada kesalahpahaman di mana Indonesia bukan hanya mengakui 6 agama resmi selain Islam, Protestan, Katolik, Hindu, Budha, Konghucu juga kepercayaan lainnya. Sejumlah negara mempertanyakan kejadian penyerangan terhadap penganut Ahmadiah, Syiah dan kaum minoritas lainnya. Dalam sisi lain, Marty mencari alibi dengan mengatakan bahwa "Indonesia mempunyai keragaman etnis, budaya dan agama serta bentuk geografis yang besar. Namun, dalam memberikan perlindungan dan peningkatan HAM ke depan diusahakan tidak akan berjalan di tempat," ujar Marty dengan mimik serius.

Sementara itu, anggota-angota negara ASEAN memberikan tanggapan yang sangat umum bahkan memuji layaknya negara sahabat. Aktivis HAM Indonesia yang enggan menyebutkan namanya malah sudah mengatakan kepada penulis agar tidak terkejut.

"Saya yakin mereka sudah kontak beberapa hari sebelumnya untuk lobi dan meyakinkan agar memberikan penilaian yang baik kepada Indonesia. Jadi, seperti hubungan timbal balik" ujar aktivis tersebut yang paham betul dengan mekanisme beluk sidang UPR.

Dalam komentar lainnya, negara dari Eropa menekan Indonesia agar meninjau kembali serta menghapuskan undang-undang hukuman mati, mengratifikasi Konvensi ROME tentang Pengadilan Kriminal Iternasional (ICC), tentang impunitas terhadap pelanggaran militer, latihan pendidikan HAM untuk polisi dan militer Indonesia, perbaikan undang-undang untuk perlindungan pekerja migran.

Berkaitan dengan daerah konflik, yang sering disinggung adalah kejadian di provinsi Papua dan Papua Barat. Hal kejutan terdapat saat sejumlah negara Eropa menyinggung kekerasan yang terjadi di kedua provinsi tersebut. Bahkan dari Australia dan Swiss menyarankan agar Indonesia mengedepankan dialog dan bekerja sama dengan pihak NGO.

“Kemitraan dengan pihak lembaga bukan pemerintah diharapkan menjadi prioritas” tekan mereka dalam ucapannya. Spanyol meminta kepada Indonesia agar diberikan akses kepada pembela hak asasi manusia, wartawan dan diplomat ke provinsi Papua dan Papua Barat.
Kejutan lainnya terjadi saat menyinggung Aceh. Negeri matador itu dalam poinnya meminta agar menghilangkan undang-undang kriminal terhadap bagi kaum homoseksual di mana sejak diperkenalkannya Syariah Islam pada tahun 2002.
Sementara itu, delegasi ASNLF yang diwakili oleh Yusuf Daud, sejak awal mengikuti jalannya rapat secara seksama mengambil inisiatif memperkenalkan HAM Aceh yang belum selesai. Salah satu mekanisme yang bisa dipakai ujar warga Swedia keturunan Aceh ini dengan membuat pernyataan sikap dari Acheh Sumatra National Libeartion Front (ASNLF).
“Pernyataan ini sangat penting kita bagi-bagikan sebelum adopsi laporan dan kesimpulan tentang Indonesia Jumat esok” ujarnya. Rencananya, pernyataan berbentuk kesimpulan HAM itu akan dibagi-bagikan ke depan panitia dan meja para hampir setiap delegasi negara, terutama Negara Uni Eropa.
Setelah rehat siang selama 2 jam, dalam ruangan berbeda di XXV Palais des Nations namun di bangunan yang sama, ditampilkan sesi tambahan bertajuk "Voices from the Ground Assesing Indonesia's Human Rights Developments through the UPR". Acara yang disponsori oleh NGO kaliber internasional seperti Forum Asia, Infid, Human Right Watch, Franciscans International dan ILGA ini menampilkan pembicara dari aktivis HAM dari Jakarta Rafendi Djamin (HRWG), Ifdhal Kasim (Komnas HAM) Yuniyanti Chuzaifah (Komnas Perempuan).
Dalam undangan terdapat daftar perwakilan ELSAM Papua namun berhalangan hadir dan diwakili oleh NGO Franciscans International. Mereka mempresentasikan permasalahan HAM Indonesia versi LSM yang berbeda seperti presentasi delegasi Indonesia beberapa jam sebelumnya. Layaknya oposisi, mekanisme demikian ditujukan untuk memberikan kesempatan kepada pihak lain agar menerima informasi kedua belah pihak.

Dari dalam bangunan kantor PBB urusan HAM yang megah Jenewa ini, berbagai bahasa, kaum dan bangsa dari 4 penjuru mata dunia datang dan duduk sejajar membicarakan masalah hak asasi manusia disetiap negaranya. Dari sini pula, akan menjadi pedoman untuk peningkatan HAM setipa negara di empat tahun mendatang.

Menlu RI Marty Natalegawa Berbohong Dalam Sidang UPR PBB, Pemerintah RI di Tekan Soal HAM

Beberapa jam lalu, catatan HAM Indonesia ditinjau oleh Dewan HAM PBB dalam sidang periodik ke-13 di Jenewa, Swiss. Isu-isu kunci, seperti perlindungan atas kebebasan beragama atau situasi HAM di Papua, diangkat oleh banyak negara anggota PBB yang turut dalam kajian HAM.
Banyak anggota Komisi HAM Asia atau AHRC (Asian Human Rights Commission) dan organisasi-bawahannya ALRC (Asian Legal Research Center) prihatin dengan penegakkan HAM di Indonesia. Atas situasi diskriminatif yang dialami kaum minoritas di Indonesia, Swedia, Jerman dan Swiss menyatakan kekecewaannya. Kelompok minoritas di Indonesia, seperti Ahmadiyah, Syiah, Baha'i dan Kristen. Mereka mendesak Pemerintah Indonesia untuk mengambil tindakan tegas terhadap mereya yang menindas dan melakukan tindak pidana hingga nyawa yang meregang dari kelompok-kelompok minoritas. 
"Tanggapan oleh pemerintah Indonesia atas isu-isu dan pelanggaran HAM yang dibahas dalam kajian ini adalah sangat mengecewakan, karena (jawaban) mereka sering hanya berisi penolakan dan menunjukkan kurangnya rasa hormat bagi korban dan hak-hak mereka," kata Wong Kai Shing, Direktur Eksekutif AHRC. Hal ini terungkap dalam laporan Situs Asian Human Rights Commission (23/5, AHRC-PRL-016-2012), yang sedang mengikuti kegiatan di Jenewa, Swiss, tanggal 23-26 Mei.

Seperti disindir sejumlah media asing, Menlu RI Marty Natalegawa dianggap berbohong, ketika memimpin delegasi Indonesia mempertanggung-jawabkan tindakan diskriminatif Pemerintah Indonesia terhadap kaum Minoritas. Marty membantah sinyalemen kelambanan pemerintah Indonesia tentang perlindungan dan penghormatan terhadap kebebasan beragama."Pemerintah Indonesia menghormati semua agama sebagai sama." 
Media asing menganggap klaim Marty bertentangan dengan semua laporan lapangan, dan tidak bersesuaian dengan, misalnya, perda-perda diskriminatif di negeri ini.Sejumlah negara, termasuk Perancis, Jepang dan Selandia Baru, mengangkat situasi di Papua, yang mencakup kekerasan yang makin meluas, penangkapan sewenang-wenang dan penahanan, serta pembatasan sah terhadap kebebasan berekspresi dan berkumpul.Prancis menyebut secara langsung perihal kesulitan media asing memperoleh akses untuk masuk ke Papua. 
Sementara itu, AS dan Jerman mengangkat artikel 106 dan 110 KUHP yang digunakan mengkriminalkan para aktivis HAM di Papua.Natalegawa menyatakan bahwa bahwa semua pelaku pelanggaran HAM di Papua sedang bertanggung jawab di 'pengadilan yang transparan dan terbuka'. Sebaliknya, AHRC dan kelompok hak asasi mendokumentasikan kasus-kasus penyiksaan dan kekerasan yang tidak mendapat tanggapan yang memadai dari pemerintah Indonesia. 
"Penolakan terhadap sejumlah pelanggaran HAM oleh militer (dan Brimob) di provinsi Papua dengan alasan impunitas (kewajiban keamanan Negara) adalah tidak dapat dipertanggung-jawabkan," kata sindir Wong Kai Shing. "Respon Pemerintah Indonesia terhadap semua tindakan pelanggaran HAM amat mengecewakan. Sikap Pemerintah RI itu merupakan kemunduran besar bagi harapan mereka yang seharusnya mendapat perlindungan yang lebih baik dan menikmati hak asasi manusia di negeri ini," pungkas Wong Kai.
Sejumlah pihak menganjurkan Pemerintah Indonesia untuk melaksanakan rekomendasi Komisi HAM PBB atau Indonesia tidak mendapat tempat terhormat dalam pergaulan internasional. Kekecewaan atas laporan Pemerintah RI dapat berdampak ketidak-percayaan pada elbagai pbidang-bidang lainnya, dalam hubungan bilateral maupun multilateral. KontraS mengapresiasi negara-negara yang secara aktif memberikan pertanyaan dan rekomendasi perbaikan kondisi HAM di Indonesia lewat sidang Universal Periodical Review (UPR) 2nd Cycle di Jenewa pada 23 Mei 2012. Namun seperti yang sudah diduga, Sesi UPR II ini masih dipenuhi jawaban-jawaban yang sama dari Pemerintah Indonesia pada Sidang UPR I tahun 2008. Itu artinya tidak ada perubahan situasi penegakan HAM di Indonesia. Mengingat kasus-kasus intoleransi, impunitas dan kekerasan terhadap pembela HAM (termasuk di Papua) masih menjadi problem-problem dominan yang belum diselesaikan.

Buku laporan International tentang HAM di Papua sepanjang 2010 – 2011 setebal 63 halaman itu di luncurkan di Aula P3W Padang Bulan, Abepura, Jayapura, Papua, Sabtu (21/4) . Laporan itu mengulas panjang lebar soal kondisi hak asasi manusia di wilayah paling timur ini. Diantaranya, kewajiban hak asasi manusia Indonesia, hak-hak sipil dan politik, hak-hak ekonomi, sosial, dan budaya, kelompok-kelompok rawan serta sektor keamanan dan hak asasi manusia di Papua. Laporan ini mengulas panjang lebar soal sejumlah kasus pelanggaran yang terjadi di Papua selama tahun 2010 – 2011.

Just prior to its Universal Periodic Review before the UN Human Rights Council, Indonesia’s commitment to democracy and free speech has been questioned with the conviction of Papuan activists, Forkorus Yaboisembut, Edison Waromi, August Makbrowen Senay, Dominikus Sorabut and Selpius Bobii (the “Jayapura 5”) for treason. All five were convicted and sentenced to 3 years in prison for expressing their political views at last year’s Third Papuan Congress, a peaceful assembly of indigenous West Papuans.
The activists were found guilty of treason under Article 106 of the Indonesian Criminal Code. This provision, used regularly in Papua to arrest and detain activists and to criminalise peaceful political activity, is inconsistent with the free speech protections found under Article 28E of the Indonesian Constitution and is contrary to Indonesia’s international obligations under the International Covenant on Civil and Political Rights (ICCPR).

Washington - Presiden Amerika Serikat Barack Obama didesak untuk menyoroti lemahnya akuntabilitas pasukan keamanan Indonesia di Papua. Lemahnya akuntabilitas selama ini mengakibatkan terus berlanjutnya tindak kekerasan dan pembunuhan di sana.

Desakan itu disampaikan oleh Human Rights Watch, lembaga penggiat hak asasi manusia yang bermarkas di Washington, Amerika Serikat, secara tertulis kepada Obama, Rabu 16 November 2011.

Obama akan berkunjung ke Indonesia untuk mengikuti Konferensi Tingkat Tinggi ke-19 ASEAN dan Konferensi Asia Timur di Nusa Dua, Bali, 17-19 November 2011.

INDONESIA: Jayapura city district police and military arbitrarily torture and arrest Papuan civilians

The Asian Human Rights Commission (AHRC) has received information regarding the arbitrary arrest and torture of 15 Papuan villagers, including several minors, in Horas Skyline village, Jayapura, Papua, committed by a joint team of Jayapura city district police and Cenderawasih military area command on 31 August 2011. Until now, there is no investigation into the incident.

CASE NARRATIVE:

According to information received from Persekutuan Gereja-Gereja Baptis Papua (The Fellowship of Baptist Churches of Papua), Koalisi Masyarakat Sipil Untuk Penegakan Hukum dan HAM di Papua (Civil Society Coalition to Uphold Law and Human Rights in Papua) and other activists, on 31 August 2011 at 5am, around 115 members of a joint team of Jayapura city district police (POLRESTA) and Cenderawasih military area command raided Papuan villagers in Horas Skyline village, Abepura district, Jayapura, Papua. All of the team members had guns and long barreled rifles, and some of them were wearing a black mask. When they were some 300 meters from the targeted houses, the team shot at the houses seven times.

Siki Kogoya, a villager who was in his yard at the time, was shocked upon hearing the gunshot, after which he saw the joint team members make their way to him. One of the members pointed his gun at Siki's mouth, while three others pointed their long barreled rifles at his neck. They then beat him with rifle butts and kicked his head, face, ribs and chest. Siki was ordered to lie face down on the ground, while the officers continued pointing their weapons at him and asked him questions regarding the location of Panius Kogoya, Etra Yanengga, and Arman Kogoya, and whether he knows Danny Kogoya. This was related to their involvement in a shooting accident in Nafri on 1 August 2011, and the killing of a taxi driver and burning of his taxi in Skyline on 6 July 2011.

AHRC-UAC-150-2011-01.jpgThe Jayapura regional police in West Papua have charged eight medical workers with incitement and objectionable acts following their peaceful protest against regulation 141/2010 by the provincial governor. The regulation deprives the Jayapura hospital's medical workers of certain payments. An earlier request to meet and discuss the situation was ignored by the governor. Moreover, the medical workers were reported to the Jayapura regional police for violating criminal law with their protest. The AHRC sees the fabrication of these charges as a violation of the workers freedom of expression. Peaceful protesters have frequently been criminally charged for incitement or disobedience in West Papua and other parts of Indonesia. CASE NARRATIVE:

The AHRC has received information from KontraS, the Commission for the Disappeared and Victims of Violence, regarding the fabrication of charges against workers who had conducted a peaceful protest. The medical workers serving in the Jayapura District Hospital have been receiving an incentive bonus since 2005. In 2010, the governor of Papua decided to alter this incentive.
